allowances and shall have such terms and conditions <strong>of</strong> <strong>of</strong>fice as<br />

may from time to time be determined by <strong>the</strong> Chief Justice with <strong>the</strong><br />

concurrence <strong>of</strong> <strong>the</strong> Prime Ministers and Premiers <strong>of</strong> all <strong>the</strong> Member<br />

States and Territories.<br />

(2) Power to make appointments to <strong>the</strong> <strong>of</strong>fice <strong>of</strong> Chief<br />

Registrar and to <strong>the</strong> o<strong>the</strong>r <strong>of</strong>fices prescribed under this section and<br />

to exercise disciplinary control over persons holding or acting in<br />

such <strong>of</strong>fices shall vest in <strong>the</strong> Judicial and Legal Services<br />

Commission.<br />

(3) Power to make appointments to <strong>of</strong>fices conferred by<br />

<strong>the</strong> provisions <strong>of</strong> this section shall be construed as including power<br />

to appoint a person to perform <strong>the</strong> functions <strong>of</strong> any such <strong>of</strong>fice<br />

during any period during which it is vacant or <strong>the</strong> holder <strong>the</strong>re<strong>of</strong> is<br />

unable for any reason to perform those functions.<br />

(4) The power to constitute <strong>of</strong>fices and make<br />

appointments <strong>the</strong>reto conferred by this section shall be in addition<br />

to any power conferred by this Constitution to constitute <strong>the</strong> <strong>of</strong>fices<br />

<strong>of</strong> and appoint for <strong>the</strong> Commonwealth <strong>of</strong> Grenada a registrar and<br />

o<strong>the</strong>r <strong>of</strong>ficers <strong>of</strong> <strong>the</strong> High Court.<br />

99.(1) For <strong>the</strong> purposes <strong>of</strong> any laws, regulations and o<strong>the</strong>r<br />

instruments relating to <strong>the</strong> grant <strong>of</strong> pensions, gratuities and o<strong>the</strong>r<br />

like benefits <strong>the</strong> judges, Chief Registrar and <strong>the</strong> holders <strong>of</strong> <strong>the</strong> o<strong>the</strong>r<br />

<strong>of</strong>fices <strong>of</strong> <strong>the</strong> Supreme Court referred to in section 12(1) <strong>of</strong> <strong>the</strong><br />

Supreme Court Order shall be in <strong>the</strong> service <strong>of</strong> Grenada as <strong>the</strong><br />

Chief Justice may, in each case, from time to time direct; and any<br />

such direction given by <strong>the</strong> Chief Justice shall take effect as from<br />

such date as may be specified by <strong>the</strong> Chief Justice and shall have<br />

effect as an appointment to a pensionable <strong>of</strong>fice in that service.<br />

(2) Where by virtue <strong>of</strong> this section any payment is made<br />

out <strong>of</strong> <strong>the</strong> funds <strong>of</strong> <strong>the</strong> Commonwealth <strong>of</strong> Grenada <strong>the</strong><br />

Governments <strong>of</strong> <strong>the</strong> o<strong>the</strong>r Member States and Territories shall pay<br />

to <strong>the</strong> Government <strong>of</strong> Grenada <strong>the</strong> proportions <strong>of</strong> that payment<br />

specified by or under section 15 <strong>of</strong> <strong>the</strong> Supreme Court Order; and<br />

<strong>the</strong> sums that are required by virtue <strong>of</strong> this subsection to be paid by<br />

<strong>the</strong> Government <strong>of</strong> any Member State or Territory are hereby<br />

charged on <strong>the</strong> Consolidated Fund <strong>of</strong> that State or Territory.<br />

100.(1) Any person who is appointed to any <strong>of</strong>fice<br />

established by or under <strong>the</strong> Supreme Court Order may resign from<br />

that <strong>of</strong>fice by writing under his or her hand addressed, in <strong>the</strong> case<br />

<strong>of</strong> <strong>the</strong> Chief Justice, to <strong>the</strong> Lord Chancellor and, in any o<strong>the</strong>r case,<br />

to <strong>the</strong> Chairman <strong>of</strong> <strong>the</strong> Judicial and Legal Service Commission.<br />

(2) The resignation <strong>of</strong> any person from any such <strong>of</strong>fice<br />

shall take effect when <strong>the</strong> writing signifying <strong>the</strong> resignation is<br />

received by <strong>the</strong> Lord Chancellor or <strong>the</strong> Chairman, as <strong>the</strong> case may<br />

be.<br />

101. The expenses <strong>of</strong> <strong>the</strong> Supreme Court (including <strong>the</strong><br />

remuneration and allowances referred to in section 11 <strong>of</strong> <strong>the</strong><br />
