Court <strong>of</strong> Justice, an appeal shall lie from decisions <strong>of</strong> <strong>the</strong> Court <strong>of</strong><br />

Appeal to <strong>the</strong> Caribbean Court <strong>of</strong> Justice in any matter involving<br />

<strong>the</strong> interpretation <strong>of</strong> this Constitution or laws <strong>of</strong> <strong>the</strong><br />

Commonwealth <strong>of</strong> Grenada.<br />

rules for <strong>the</strong> practices<br />

and procedures <strong>of</strong> <strong>the</strong><br />

Judiciary<br />

96. The Chief Justice <strong>of</strong> <strong>the</strong> Eastern Caribbean Supreme<br />

Court may make Rules with respect to <strong>the</strong> practices and procedures<br />

<strong>of</strong> <strong>the</strong> High Court, Court <strong>of</strong> Appeal, and <strong>of</strong> <strong>the</strong> Magistrates’ Courts<br />

established under this Constitution, in relation to jurisdiction and<br />

powers conferred upon <strong>the</strong>m by or under this Section or any o<strong>the</strong>r<br />

law.<br />

<strong>of</strong> Judges<br />

Chief Registrar and<br />

o<strong>the</strong>r <strong>of</strong>ficers<br />

97.(1) The Chief Justice, <strong>the</strong> Justices <strong>of</strong> Appeal and <strong>the</strong><br />

Pusine Judges shall be paid <strong>the</strong> salaries specified in schedule 3 <strong>of</strong><br />

<strong>the</strong> Supreme Court Order, and shall be entitled to such allowances<br />

and shall have such terms and conditions <strong>of</strong> <strong>of</strong>fice as may from<br />

time to time be determined by <strong>the</strong> Judicial and Legal Services<br />

Commission with <strong>the</strong> concurrence <strong>of</strong> <strong>the</strong> Prime Ministers and<br />

Premiers <strong>of</strong> all <strong>the</strong> Member States and Territories <strong>of</strong> <strong>the</strong><br />

Organization <strong>of</strong> Eastern Caribbean States:<br />

Provided that–<br />

(a) <strong>the</strong> salaries specified in schedule 3 to <strong>the</strong><br />

Supreme Court Order may be altered by<br />

order made by <strong>the</strong> Judicial and Legal<br />

Services Commission with <strong>the</strong><br />

concurrence <strong>of</strong> <strong>the</strong> Prime Ministers and<br />

(b)<br />

Premiers <strong>of</strong> all <strong>the</strong> States and Territories;<br />

<strong>the</strong> salary and allowances (o<strong>the</strong>r than<br />

allowances which are not taken into account<br />

in <strong>the</strong> computation <strong>of</strong> pensions) <strong>of</strong> a judge<br />

shall not be reduced and <strong>the</strong> terms and<br />

conditions <strong>of</strong> <strong>of</strong>fice applicable to a judge<br />

upon his or her appointment shall not be<br />

made less favourable to him or her during<br />

<strong>the</strong> currency <strong>of</strong> that appointment.<br />

(2) Where a judge is entitled to exercise an option in<br />

relation to his or her salary or <strong>the</strong> o<strong>the</strong>r matters referred to in<br />

proviso (b) to subsection (1) <strong>of</strong> this section, <strong>the</strong> option as exercised<br />

by him or her shall be deemed for <strong>the</strong> purposes <strong>of</strong> that proviso to be<br />

in his or her favour.<br />

98.(1) There shall be, for all <strong>the</strong> Member States and<br />

Territories an <strong>of</strong>fice <strong>of</strong> Chief Registrar and such o<strong>the</strong>r <strong>of</strong>fices <strong>of</strong> <strong>the</strong><br />

Supreme Court as <strong>the</strong> Chief Justice may from time to time<br />

prescribe by order made with <strong>the</strong> concurrence <strong>of</strong> <strong>the</strong> Prime<br />

Ministers and Premiers <strong>of</strong> all <strong>the</strong> Member States and Territories;<br />

and <strong>the</strong> holders <strong>of</strong> such <strong>of</strong>fices shall be paid such salaries and<br />
