Application
This report assesses the proposal against the Planning Scheme and takes into account
representations received during the public exhibition period. The subject property is
located towards the western side of the township of Wynyard. This site is currently
zoned Residential under the Planning Scheme.
The development is for a Subdivision, which does not have a Use Class under the
Waratah-Wynyard Planning Scheme 2000, therefore it is to be assessed as a
discretionary application under the Local Government (Building and Miscellaneous
Provisions) Act 1993, Part 3 Subdivisions, s.81(2)
“(2) Unless the relevant planning scheme or interim order provides otherwise, an
application for approval of a subdivision plan is to be made as if it were an
application for a discretionary permit under section 57 of the Land Use Planning
and Approvals Act 1993.”
