A previous Development Application (SD 1815) for a 3 lot subdivision of the land was
refused by Council at its meeting on 15 December 2008. The grounds for refusal were as
follows:
“The proposal is contrary to the Industrial Values articulated under Part 8.0 Clause
8.1 and Part 2.0 Clause 2.2.4 of the Waratah-Wynyard Planning Scheme 2000, as
reticulated sewerage services are not available to provide for a wide range of
Industrial Activities.
“The proposal is contrary to the Industrial Zone Intent articulated under Part 8.0
Clause 8.2 of the Waratah-Wynyard Planning Scheme 2000, as it is not capable of
providing for a range of Industrial Activities.
“The applicant has not demonstrated compliance with the Infrastructure Provision
Objective under Clause 8.4.1, Issue 10 of the Waratah-Wynyard Planning Scheme
2000”.
A subsequent Development Application (SD 1827) for a 3 lot subdivision was lodged in
2009. An additional information request sought demonstration that the application
complied with the objectives associated with Clause 8.4.1, Issue 3 and Clause 8.4.1, Issue
10 of the Planning Scheme. The application was subsequently withdrawn.
