Art. 11<br />

Transshipments and vessel sighting<br />

1. Transshipments only to Contracting Party or<br />

Cooperating non-Contracting Party, Entity or Fishing<br />

Entity vessels. Inspection, information to the<br />

Commission.<br />

2. Sighting of stateless vessel to be reported to the<br />

authorities of the sighting State.<br />

Inspection, information to the Secretariat and to the<br />

Contracting Parties.<br />

3. Fishing activities presumed to be IUU.<br />

4. In case of sighing of an IUU vessel of a<br />

Contracting Party, report to the competent authorities<br />

of the sighter who will contact the authorities of the<br />

flag. Information to the Secretariat.<br />

5. In case of sighting of a non-Contracting Party<br />

vessel, immediate information to the sighting State.<br />

Report to the flag State and to the Secretariat who<br />

will inform all the Contracting Parties.<br />

Part II - CONTRACTING PARTY OBLIGATIONS<br />

Art. 12<br />

1. Quarterly transmission of provisional statistics on<br />

catches.<br />

2. The Secretariat will circulate the statistics.<br />

3. Monthly report to the flag State on catches subject<br />

to TAC or quota.<br />

4. Retention on board authorized only when flag has<br />

a quota and that quota is not exhausted.<br />

General principles for inspection and surveillance<br />

1. Each Party shall assure compliance.<br />

2. Each Party shall monitor and inspect, within its<br />

territory and maritime waters, all activities on ICCAT<br />

species.<br />

3. Monitoring and inspection on the high seas by the<br />

flag State.<br />

4. Vessels and aircraft available to inspectors.<br />

5. Duly authorized inspectors.<br />

6. Halt fishing activities in case of serious infraction.<br />

7. Investigations, and dissuasive sanctions.<br />

8. Vessel flying flag of another State. Information<br />

and evidence should be communicated to the flag<br />

State. ICCAT shall inform all the Parties after<br />

reaction from flag State.<br />

9. Annual report on infractions and sanctions.<br />

10. and 11. Mutual agreement for exchange of<br />

inspectors.<br />
