Part VI - OBSERVATION SCHEME<br />
Art. 28<br />
Common standards to apply if the Commission<br />
decides to implement an observer scheme:<br />
1. Responsibility of the flag State. Independent and<br />
impartial observers. One observer only.<br />
2. Transmission of the list of observers to ICCAT.<br />
3. Observer’s tasks:<br />
- Monitor in accordance with ICCAT<br />
- Collect catch and effort data.<br />
- Verify catch composition, by-catches, discards,<br />
small fish, logbooks<br />
- Reports and confidentiality<br />
- No interference in the normal functioning of the<br />
vessel.<br />
4. If infringement presumed, inform the Party of the<br />
flag and the Executive Secretary.<br />
5. Observer’s duties and salary.<br />
6. Catch retained on board and duty to cooperate.<br />
7. Arrangements for exchange of observers.<br />
Part VII - PROGRAM TO PROMOTE<br />
COMPLIANCE BY NON-CONTRACTING PARTY<br />
VESSELS<br />
Art. 29<br />
1. Exchange of information on activities of NCP<br />
vessels in the ICCAT area. Sharing of information<br />
with other RFOs.<br />
2. The Contracting Party can directly or via ICCAT<br />
adopted measures to discourage activities that<br />
undermine the effectiveness of the ICCAT measures.<br />
Art. 30<br />
1. A non-Contracting Party vessel observed in the<br />
ICCAT area is presumed to undermine ICCAT<br />
measures.<br />
2. Mandatory port inspection before landing.<br />
3. Prohibition of landing at the ports of all the<br />
Contracting Parties if the fish are from the ICCAT<br />
area.<br />
4. Results of the inspections and monitoring will be<br />
transmitted to all the Contracting Parties and the flag<br />
State.<br />

1. General comments<br />
The EC proposal is comprehensive. Japan highly appreciates EC for producing this useful document. But it<br />
seems to be too ambitious to include many elements (VMS, at-sea inspection, port inspection, etc.) into a single<br />
