3. Ensure that any modification to the documents and to the information referred to in paragraph 1 is certified<br />
by the competent authority of that Contracting Party.<br />
Article 6 - Marking of fishing vessels<br />
Each Contracting Party shall ensure that its fishing vessels authorised to fish in the Convention area are marked<br />
in such a way that they can be really identified with generally accepted standards such as the FAO Standard<br />
specification for the marking an identification of Fishing vessels.<br />
Article 7 - Marking of gear<br />
1. Each Contracting Party shall ensure that gear used by its fishing vessels authorised to fish in the Convention<br />
Area is marked as follows: the ends of nets, lines and gear anchored in the sea shall be fitted with flag or<br />
radar reflector buoys by day and light buoys by night sufficient to indicate their position and extent. Such<br />
lights should be visible at a distance of at least 2 nautical miles in good visibility.<br />
2. Marker buoys and similar objects floating and on the surface and intended to indicate the location of fixed<br />
fishing gear shall be clearly marked at all time with the letter(s) and/or number(s) of the vessel to which they<br />
belong.<br />
3. Fish aggregating devices shall be clearly marked at all time with the letter(s) and / or number(s) of the vessel<br />
to which they belong.<br />
Article 8 - Recording of catch<br />
1. Each Contracting Party shall ensure that all fishing vessels flying its flag and authorised to fish in the<br />
Convention Area keep a bound fishing logbook.<br />
2. Fishing logbooks shall contain the information provided in “ICCAT Field Manual”<br />
Article 9 - Vessel Monitoring System<br />
1. Each Contracting Party, Cooperating non contracting Party, Entity and Fishing Entity, shall implement no<br />
later than (…), a Vessel Monitoring System (hereinafter referred to as VMS) for its fishing vessels<br />
exceeding 20 metres between perpendiculars or 24 metres length overall which fish for ICCAT species on<br />
the high sea outside the Exclusive Economic Zone of any coastal state and:<br />
a) Require its fishing vessel, fishing in the Regulatory Area, to be equipped with an autonomous system<br />
able to automatically transmit a message to a land-based Fisheries Monitoring Centre (hereinafter<br />
referred to as FMC) allowing a continuous tracking of the position of a fishing vessel by the<br />
Contracting Party of that fishing vessel in conformity with the specifications and schedule set out<br />
defined by the Commission.<br />
b) Ensure that the satellite tracking device fitted on board the fishing vessels, shall enable the vessel to<br />
transmit, at any time, to the Contracting Party, Cooperating non-contracting Party, Entity and Fishing<br />
Entity the following data:<br />
(i) the vessel identification;<br />
(ii) the most recent geographical position of the vessel (longitude, latitude) with a margin of error<br />
lower than 500 metres, with a confidence interval of 99%;<br />
(iii) the date and time of the fixing of the said position of the vessel.<br />
2. Each Contracting Party, Cooperating non-Contracting Party, Entity or Fishing Entity shall take the<br />
necessary measures to ensure that the FMC (receives through the VMS the messages requested in paragraph<br />
1.b.).<br />
3. Each Contracting Party, Cooperating non contracting Party, Entity or Fishing Entity shall ensure that the<br />
Masters of fishing vessels flying its flag shall ensure that the satellite tracking devices are permanently<br />
operational and that the information identified in paragraph 1.b) is transmitted every 6 hours. In the event of<br />
a technical failure or non-operation of the satellite-tracking device fitted on board a fishing vessel, the<br />
device shall be repaired or replaced within one month. After this period, the master of a fishing vessel is not<br />
authorised to commence a fishing trip with a defective satellite-tracking device. Furthermore where a device<br />
stops functioning or has a technical failure during a fishing trip lasting more than one month, the repair or<br />
the replacement has to take place as soon as the vessel enters a port; the fishing vessel shall not be<br />
authorised to continue or commence a fishing trip without the satellite tracking device having been repaired<br />
or replaced.<br />
