Boarding and inspection<br />

Routine boarding and inspection on an at-random basis<br />

Boarding and inspection on a basis of suspected<br />

serious violations<br />

(1) Frequency of the boarding shall be decided equitably<br />

among all the fishing vessels operating in the<br />

Regulatory Area in consideration of the need of such<br />

inspection as well as other available MCS measures.<br />

(2)The flag CPC should, in principle, conduct boarding<br />

and inspection.<br />

(3)For boarding and inspection by a party other than the<br />

flag CPC, an arrangement for well preparation and<br />

coordination shall be made among participating CPCs<br />

prior to its implementation.<br />

(1) The inspector of the patrol vessel of any CPC<br />

shall notify of the flag CPC immediately in case,<br />

(a) where there is a clear ground to believe that<br />

the fishing vessel is or has been operating in<br />

such serious violation of conservation and<br />

management measure adopted by the<br />

Commission and,<br />

(b) where such boarding and inspection is<br />

necessary to obtain or verify evidence<br />

documenting such a serious violation different<br />

from evidence that can be obtained without<br />

such boarding.<br />

(4)A flag CPC that does no have sufficient capability to<br />

dispatch its own inspection vessel to the Regulatory<br />

Area shall conduct the boarding and inspection in<br />

arrangements with other CPCs that have a capability<br />

to do so.<br />

Procedure<br />

1. In advance notice to fishing vessels<br />

2. The Master’s accommodation to the inspectors for<br />

boarding and inspection<br />

3. In case of the Master’s denial to boarding and<br />

inspection, the incident has to be notified to the flag<br />

party/member with an explanation on the denial.<br />

(2) Upon receipt of the notification of (1) above,<br />

the flag CPC shall take either of the following<br />

measures immediately.<br />

(a) to conduct boarding inspection by its<br />

inspection vessel,<br />

(b) to order the Master to enter the nearest port<br />

for inspection, or<br />

(c) to authorize the inspector who notified the<br />

suspected violation to conduct boarding and<br />

inspection.<br />

(3) The inspector shall inform the Master of the<br />

vessel of the reasons for the boarding, including<br />

the possible violation he or she may commit<br />

before boarding of (2) (c) above.<br />
