21. Soliciting/selling for personal or organizational profit without proper<br />
consent of university officials.<br />
22. Violating motor vehicle policies of the university.<br />
23. Disruption of the normal activities of the institution, including<br />
physical violence or abuse of any person or conduct which threatens or endangers the<br />
health or safety of persons, the deliberate interference with academic freedom and<br />
freedom of speech, and forcible interference with the freedom of movement of any<br />
member or guest of the university.<br />
24. Possession of weapons, which include firearms (or replicas), bb guns,<br />
sling shot devices, grenades, knives, explosives, flammable materials or any other<br />
instrument which may be used to cause injury to body or damage to property.<br />
25. Violations of university’s policies or regulations governing student<br />
behavior and life of the campus and failure to inform personal guest of said policies<br />
and/or regulations.<br />
26. Any violation of federal, state or local law if such directly affect the<br />
university’s pursuit of its proper education purposes.<br />
27. Misuse of controlled and/or harmful drugs including alcohol.<br />
28. Failure to comply with directions of university officials acting in the<br />
performance of their duties. This shall include failure to give identity or to show<br />
university identification card.<br />
29. Violation of university computer policies.<br />
30. Violation of other published university policies, rules or regulations.<br />
JUDICIAL POLICIES<br />
The university, through the vice president for student services, has the duty and<br />
corollary disciplinary power to protect its educational purpose and objectives through setting<br />
standards of conduct.<br />
Judicial processes and procedures are substantially secondary to the use of example,<br />
guidance, counseling, and admonition in the development of responsible student conduct.<br />
However, when these preferred means fail to resolve problems of student conduct, procedural<br />
safeguards allow for proper action while protecting the student from unfair imposition of<br />
serious penalties.<br />
The judicial process is not a criminal process; however, basic due process rights will<br />
be protected.<br />
JUDICIAL PROCESS<br />
At <strong>Barry</strong> <strong>University</strong>, disciplinary procedures are substantially secondary to the use<br />
of example, counseling, guidance, and admonition in the maintenance of responsible behavior.<br />
The judicial process is not a criminal process; however, basic due process rights will be<br />
protected.<br />
The university has the duty of corollary disciplinary power to protect its educational<br />
purpose through setting standards of scholarship and student conduct and through regulating<br />
the use of its facilities. In exceptional circumstances, when the preferred means to resolve the<br />
problems of student conduct fail, procedural safeguards allow proper action while protecting<br />
the student from an unfair imposition of serious penalties.<br />
The campus judicial process permits any member of the university community<br />
(student, faculty, administrator or staff) to register a complaint against a student/student<br />
organization (undergraduate and graduate) with the judicial coordinator. If the complaint<br />
warrants adjudication the judicial coordinator (a member of student services staff) will send for<br />
the accused student/student organization and discuss options available for adjudication. Any<br />
judicial case can be heard by either the appointed student service administrator or the<br />
university judicial board. Pending action on the complaint, the status of an accused student is<br />
