A student dismissed for disciplinary reasons at any time shall not be entitled to any<br />
claim or refund.<br />

UNIVERSITY EMPLOYEE<br />
Grievance Procedures<br />
If any student feels the need to file a grievance against a university employee he or<br />
she must report such incident to the dean of students. Every effort will be made to protect the<br />
privacy of any parties involved. After an informal discussion, if the student wishes to file a<br />
formal grievance, he/she may submit same in writing to the dean of students. However, before<br />
filing a formal charge, the complaining party must first make a good faith effort to meet and<br />
confer with the party against whom he or she has a complaint in an effort to resolve the matter.<br />
Upon receipt of a written formal complaint by a student, the dean of students shall<br />
refer the complaint for investigation to the office of the vice president of the appropriate<br />
division.<br />
The above recipients of such complaints will investigate and determine whether the<br />
grievance has merit as alleged.<br />
If it is determined that such grievance has appropriate support, the persons or<br />
departments that are responsible for such violation will be dealt with in an appropriate manner<br />
by the supervisors or directors of such persons or programs, in accordance with applicable<br />
provisions, if any, of contracts, employment regulations, faculty manuals, or the like.<br />
Remedies<br />
After investigation, if the allegation grievance is deemed justified by the<br />
investigating officer, said officer will take whatever steps he or she believes are appropriate to<br />
correct any grievance suffered by the complaining student.<br />
Review by the President<br />
The president of <strong>Barry</strong> <strong>University</strong> shall review any determinations and/or actions<br />
taken hereunder and shall have the power to reverse or amend any decisions of the<br />
investigating officer provided such action is taken by the president within 90 days of the said<br />
determination. The president’s determination shall be final and binding on <strong>Barry</strong> <strong>University</strong><br />
and the student. Failure of the president to amend or reverse decisions within 90 days as<br />
aforestated shall constitute approval of the investigating officer’s decision.<br />
Use of Outside Remedies<br />
If, prior to filing a formal complaint hereunder or while such complaint proceedings<br />
are in the progress as provided in the general policy, a grievant seeks resolution of his/her<br />
grievance in any other forum, be it administrative or judicial, the <strong>University</strong> shall have the<br />
right, in its sole discretion, to terminate any further consideration of the complaint without<br />
further notice to the complainant. (Approved ECA 6/17/98)<br />
