for them before the FIFA competent bodies. It is free<br />

to do so. However the Panel wishes to stress that this<br />

statement made in the present award (the fact that<br />

the Claimant may, potentially and in abstract, request<br />

for sporting sanctions before the FIFA competent<br />

bodies) does not mean at all that this Panel makes<br />

any pronouncement on (i) the admissibility of such a<br />

request in the referred bodies and (ii) the imposition<br />

or not of such sporting sanctions, as this does not fall<br />

within the scope of the present proceedings.<br />

5. Conclusion<br />

To summarize, the Panel has decided that:<br />

- The claim fi led by Shakhtar is partially upheld, and<br />

the Player is ordered to pay to Shakhtar the amount<br />

of EUR 3.572.558,80 (2.194.896 + 1.932.358,94<br />

– 554.696,14) plus 5% interest per annum from<br />

the date of the Agreement’s termination (17 May<br />

2010).<br />

- The counterclaim fi led by the Player is rejected.<br />

The above conclusion, fi nally, makes it unnecessary<br />

for the Panel to consider the other requests submitted<br />

by the parties to the Panel. Accordingly, all other<br />

prayers for relief are rejected.<br />

C. Confi dentiality<br />

In the present proce<strong>du</strong>re, at the hearing of 13 May<br />

2011, both parties have agreed that the award shall<br />

be made public.<br />

Therefore, the present award is not confi dential and<br />

shall be published.<br />
