Violations and Associated Penalties(a) The primary intent of Penalties is to ensure that the system performs in accordance with thedefined service levels. Penalties are not meant to be punitive or, conversely, a vehicle foradditional fees.(b) A six monthly performance evaluation will be conducted using the six monthly reportingperiods of that period.(c) Penalty Calculations. The framework for Penalties, as a result of not meeting the ServiceLevel Targets are as follows:(i) The performance will be measured for each of the defined service level metric against theminimum / target service level requirements and the violations will be calculatedaccordingly.(ii) The number of violations in the reporting period for each level of severity will be totaledand used for the calculation of Penalties.a. If the total number of credits gained by the SI is lower than the total number of highseverity violations in the reporting period, the total number of credits will besubtracted from the total number of High Severity Violations in the reporting periodfor the calculation of Penalties.b. If the total number of credits gained by the SI is higher than the total number ofhigh severity violations in the reporting period, the resultant total number of highseverity violations in the reporting period for calculation of penalties will beconsidered as zero (0).Volume III Request for Proposal for Selection of System Integrator Page 78 of 132
Crime & Criminals Tracking Network and Systems ProjectSikkim Police(iii) Penalties applicable for each of the high severity violations is two (2) % of respective halfyearly payment to the SI.(iv) Penalties applicable for each of the medium severity violations is one (1%) of respectivehalf yearly payment to the SI.(v) Penalties applicable for each of the low severity violations is half percentage (0.5%) ofrespective half yearly payment to the SI.(vi) Penalties applicable for not meeting a high (H) critical performance target in twoconsecutive half years on same criteria shall result in additional deduction of 5% of therespective half yearly payment to the SI. Penalty shall be applicable separately for eachsuch high critical activity(vii) Penalties applicable for not meeting a medium (M) critical performance target in twoconsecutive half yearly periods on same criteria shall result in additional deduction of 3%of the respective half yearly payment to the SI. Penalty shall be applicable separately foreach such medium critical activity(viii) Penalties applicable for not meeting a low (L) critical performance target in twoconsecutive half yearly periods on same criteria shall result in additional deduction of 2%of the respective half yearly payment to the SI. Penalty shall be applicable separately foreach such medium critical activityIt is to be noted that if the overall penalty applicable for any of the review period during thecurrency of the contract exceeds 25% or if the overall penalty applicable for any of the successivehalf year periods during the currency of the contract is above 15%; then the Sikkim Police shallhave the right to terminate the contractVolume III Request for Proposal for Selection of System Integrator Page 79 of 132
