c. PLC (Law). A member of the PLC(L) Program, upon appointment to<br />

commissioned grade, will be placed on inactive duty. As a commissioned<br />

officer in the MCR the member will remain on inactive duty for a specified<br />

period of time in order to satisfactorily complete the requirements<br />

for a law degree and is admitted to the practice of law before<br />

the bar of a Federal court or the highest court of a state or the<br />

District of Columbia. These officers will be eligible for promotion at<br />

the same time as their contemporaries on active duty.<br />

(1) In order to effect the promotion of members of the PLC Law<br />

Program OSO’s must forward a written request for promotion accompanied<br />

by a promotion physical to the CMC (MRRO-2) not later than 60 days<br />

prior to the expected date of promotion.<br />

(2) After receipt of their law degree, members must take the<br />

first scheduled state or (DC) bar examination, within the jurisdiction<br />

of their choice. In the event they fail the first examination, they<br />

will be required to take the next scheduled examination. They will not<br />

be ordered to TBS until the results of the second examination have been<br />

reported to the CMC (MRRO-2). If the member fails the second bar<br />

examination, they will be ordered to the next available Basic School<br />

Class as an unrestricted ground officer.<br />

(3) Officers, who successfully pass the bar exam, will be<br />

assigned to EAD for the period of time specified by their service<br />

agreements. Initial orders to EAD will be to attend TBS, MCCDC,<br />

Quantico, Virginia. Following completion of TBS, the above officers<br />

will be ordered to either the Naval Justice School, Newport, Rhode<br />

Island, or assigned directly to duty. When certified by the Judge<br />

Advocate General of the U.S. Navy, members will be designated as Judge<br />

Advocates and assigned the appropriate MOS.<br />

(4) Subsequent to acceptance of appointment to commissioned<br />

grade, these officers will normally be assigned to EAD for the period<br />

specified in their service agreements as unrestricted ground officers<br />

should they:<br />

(a) Fail to maintain the academic standard prescribed by<br />

the academic institution of attendance for completion of requirements<br />

for a law degree;<br />

(b) Fail to complete the requirement for a law degree<br />

within the standard period of time required for a full-time law<br />

student; or<br />

(c) Discontinue law studies for any reason.<br />

d. PLC Members who have Received Financial Assistance. PLC<br />

members awarded <strong>Marine</strong> <strong>Corps</strong> financial assistance are obligated for<br />

active duty in addition to that period of time specified in their basic<br />

service agreement. For further information on financial assistance,<br />

refer to paragraph 2100.9 of this Manual.<br />

e. PLC Members who have Participated in Flight Indoctrination.<br />

PLC members receiving flight instruction beyond the solo stage<br />

(normally 12 hours), and who remain physically qualified are obligated<br />

to repay to the Government the cost of all flight instruction should<br />

they fail to accept their commission.<br />

5. Grade While Member<br />

a. Applicants for the PLC Program will be enlisted in the grade of<br />

private.<br />

b. Upon approval and designation as a PLC, members will hold the<br />

title of "Candidate." Members of the PLC Program are entitled to pay<br />

and allowances while attending Officer Candidates School for their<br />

enlisted grade but not less than those prescribed for sergeant.<br />

c. Candidates who assume a nontraining status (i.e., are disenrolled<br />

for any reason and are placed in a casual status) will be<br />

reverted to the grade held when initially ordered to Officer Candidates<br />

School and receive pay and allowances of that grade, except for<br />

individuals meriting special consideration as determined by the<br />

Commanding Officer, Officer Candidates School. Candidates returned to<br />

training from a nontraining status will be concurrently reinstated as<br />

officer candidates and entitled to the pay and allowances stated in<br />

paragraph 2100.5b, above.<br />
