elementów farmy wiatrowej. Decyzja o pozwoleniu na<br />
budowę wygasa, jeżeli budowa nie została rozpoczęta<br />
przed upływem 3 lat od dnia, w którym decyzja ta<br />
stała się ostateczna.<br />
Zgłoszenie robót budowlanych<br />
Notification of Construction Works<br />
Nie wszystkie elementy <strong>in</strong>frastruktury farmy wiatrowej<br />
wymagają uzyskania pozwolenia na budowę. Pozwolenia<br />
na budowę nie wymaga budowa przyłączy<br />
elektromagnetycznych, dla których wystarczy samo<br />
zgłoszenie robót budowlanych zawierające rodzaj,<br />
zakres i sposób wykonywania robót budowlanych<br />
oraz term<strong>in</strong> ich rozpoczęcia. Do wykonywania robót<br />
budowlanych można przystąpić, nie później niż po<br />
upływie 2 lat od określonego w zgłoszeniu term<strong>in</strong>u ich<br />
rozpoczęcia.<br />
Zmiana pozwolenia na budowę<br />
Change of Construction Permit<br />
W praktyce realizacji projektów farm wiatrowych<br />
często pojawia się konieczność wprowadzenia zmian<br />
do projektu budowlanego już po jego zatwierdzeniu<br />
przez odpowiednie organy oraz po wydaniu pozwolenia<br />
na budowę. Taką zmianą może być przykładowo<br />
modyfikacja kształtu fundamentów. Istotne odstąpienie<br />
od zatwierdzonego projektu budowlanego jest<br />
dopuszczalne jedynie po uzyskaniu decyzji o zmianie<br />
pozwolenia na budowę. Podmiotem uprawnionym<br />
do dokonania kwalifikacji danego odstąpienia, jako<br />
istotne lub nieistotne jest w tym zakresie projektant.<br />
Jest on obowiązany zamieścić w projekcie budowlanym<br />
odpowiednie <strong>in</strong>formacje (rysunek i opis)<br />
dotyczące odstąpienia. Projektant ponosi wyłączną<br />
odpowiedzialność cywilną i karną w zakresie dokonanej<br />
kwalifikacji.<br />
Pozwolenie na użytkowanie<br />
Occupancy Permit<br />
Przed przystąpieniem do użytkowania obiektu<br />
budowlanego należy uzyskać ostateczną decyzję<br />
o pozwoleniu na użytkowanie. Jej uzyskanie jest<br />
konieczne, jeżeli dla wzniesienia obiektu budowlanego<br />
jest wymagane pozwolenie na budowę i obiekt jest<br />
zaliczony do określonych prawem kategorii. W większości<br />
przypadków budowa elektrowni wiatrowych<br />
wymaga uzyskania pozwolenia na użytkowanie.<br />
Jednak w związku z tym, że polskie organy klasyfikują<br />
farmę wiatrową do różnych kategorii budowlanych,<br />
zdarza się, że taki obowiązek nie zostaje nałożony.<br />
Jeżeli uzyskanie pozwolenia na użytkowanie nie jest<br />
wymagalne, do użytkowania obiektu budowlanego,<br />
można przystąpić, po zawiadomieniu organu nadzoru<br />
budowlanego o zakończeniu budowy, a organ ten nie<br />

components of a w<strong>in</strong>d farm. The decision grant<strong>in</strong>g<br />
construction permit expires if construction works are<br />
not started <strong>in</strong> 3 years from the date of the decision<br />
becom<strong>in</strong>g f<strong>in</strong>al.<br />
Not all components of w<strong>in</strong>d farm <strong>in</strong>frastructure require<br />
a construction permit. Such permit does not have to<br />
be sought for power service connections – for those it<br />
is only sufficient to provide notification of construction<br />
works specify<strong>in</strong>g the type, scope and method of the<br />
works, and the construction commencement date.<br />
Construction works should start no later than <strong>in</strong><br />
2 years from the commencement date <strong>in</strong>dicated <strong>in</strong> the<br />
notification.<br />
In the practice of w<strong>in</strong>d farm project implementation, it<br />
oftentimes turns out that the construction design must<br />
be changed after it has been approved by competent<br />
authorities or after the construction permit has been<br />
issued. Changes to construction design may <strong>in</strong>clude,<br />
for example, modify<strong>in</strong>g the shape of foundations.<br />
A substantial departure from the terms set forth <strong>in</strong> the<br />
construction permit is only permissible after a decision<br />
amend<strong>in</strong>g the construction permit is granted. To that<br />
extent, decisions as to whether a given departure<br />
is substantial or not are made by the designer, who<br />
is obliged to <strong>in</strong>clude the respective <strong>in</strong>formation<br />
regard<strong>in</strong>g the departure from the design (draw<strong>in</strong>g and<br />
description) <strong>in</strong> the construction design. The designer<br />
bears civil and penal liability for the qualification of the<br />
departure.<br />
Before a structure is put to bus<strong>in</strong>ess use, the f<strong>in</strong>al<br />
decision regard<strong>in</strong>g its occupancy permit needs to<br />
be obta<strong>in</strong>ed. The occupancy permit requirement<br />
exists if construction permit was required to erect<br />
the structure, and if the structure falls <strong>in</strong>to one of<br />
the categories def<strong>in</strong>ed by law. In most cases, w<strong>in</strong>d<br />
farm development requires an occupancy permit.<br />
However, s<strong>in</strong>ce Polish authorities classify a w<strong>in</strong>d<br />
farm <strong>in</strong>to different construction categories, there<br />
are certa<strong>in</strong> <strong>in</strong>stances where the occupancy permit<br />
obligation is not imposed. If the occupancy permit<br />
is not required, a structure can be put to bus<strong>in</strong>ess<br />
use after the competent construction supervisory<br />
authority is notified that the construction has been<br />
completed, provided that the authority does not raise
