modyfikacją, że utrata praw nastąpi po przekroczeniu
progu 105% ceny gwarantowanej oraz tylko dla
energii sprzedawanej po wyższej cenie. Tym razem
Ministerstwo Gospodarki w uzasadnieniu do ustawy
OZE szczegółowo wyjaśnia intencje wprowadzenia
powyższego rozwiązania. Stanowi ono kompromis
pomiędzy promocją OZE, a koniecznością wyeliminowania
nadmiernego wsparcia dla producentów
energii z OZE. Ministerstwo twierdzi, że proponowane
rozwiązanie nie jest zbyt rygorystyczne i umożliwi
pełną konkurencyjną sprzedaż energii na rynku
regulowanym, gdyż 105 % to równowartość 208,74 zł/
MWh. Stanowi to więcej niż średnia cena energii
sprzedanej za I, jak i II kwartał 2012 roku.
Wsparcie w okresie rozruchu technologicznego
W okresie rozruchu technologicznego, trwającego nie
dłużej niż 90 dni, przysługuje wsparcie na pełnych
zasadach. Ustawa OZE w wersji 2.0.1 doprecyzowuje,
że wartość współczynnika korekcyjnego ustala się
odrębnie dla rozruchu technologicznego oraz okresu
po oddaniu instalacji do użytkowania.
Repowering
Wprowadzona została dodatkowa przesłanka
uzyskania prawa do świadectwa pochodzenia za
energię z instalacji zmodernizowanej. W wyniku
modernizacji musi dodatkowo nastąpić przyrost
mocy zainstalowanej energii elektrycznej, przy czym
świadectwo będzie przysługiwać proporcjonalnie do
przyrostu mocy.
Świadectwa statystyczne
O wydanie świadectw pochodzenia w zakresie
zakupu energii z mikro i małych instalacji będą mogli
występować sprzedawcy zobowiązani. W współczynnik
korekcyjny dla energii z takich źródeł ma
wynosić 0,005.
Opłata OZE
Wprowadzono nową instytucję tzw. opłaty OZE. Ma
ona na celu pokrycie kosztów operatorów energetycznych
wynikających z zakupu energii produkowanej
w mikro- i małych instalacjach OZE po cenie
wyższej niż rynkowa cena sprzedaży energii. Płatnik
Opłaty OZE będzie pobierał od odbiorcy końcowego
„Ostateczną Opłatę OZE”. Stawka opłaty OZE w 2013
roku ma wynosić 0,60813510 zł za 1 MWh.
Odbiorca Przemysłowy
Poszerzono krąg podmiotów mogących samodzielnie
uzyskać i przedstawić do umorzenia świadectwo
pochodzenia o odbiorcę przemysłowego, który
w poprzednim roku kalendarzowym zużył nie mniej
Loss of entitlement to certificates
Despite the numerous objections and doubts
concerning the compatibility with the Constitution,
there is retained the principle, introduced in the second
version of the draft of the RES Act, regarding the loss of
entitlement to certificates in the event of selling energy
at a price which exceeds the statutory guaranteed
energy purchase price, however, with a modification
that the said loss shall take place after exceeding the
threshold of 105% of the guaranteed price and that it
applies only to the energy that is being sold at a higher
price. This time, in the justifications to the RES Act, the
Ministry of Economy explains in detail the intentions of
implementing the aforementioned solution. It constitutes
a compromise between the promotion of RES and the
necessity to eliminate the excessive support to the
suppliers of the energy produced from RES. The Ministry
of Economy claims that the suggested solution is not
that rigorous and will enable a full competitive sale of
energy on the regulated market, since 105% equals PLN
208,74/MWh. This constitutes more than the average
selling price for the energy sold both in the first and
second quarter of 2012.
Support during the technological start-up period
During the technological start-up period, which period
shall last no longer than 90 days, one is entitled to
obtain support on a full basis. The RES Act, version
2.0.1, specifies that the value of the correction rate
is to be established separately for the technological
start-up period and the period after commissioning the
installation.
Repowering
There was introduced an additional prerequisite of
obtaining the entitlement to a certificate of origin for the
energy produced from a modernized installation. As
a result of the modernization, there has to be a growth
in the capacity of the installed electric energy, whereas
one shall be entitled to a certificate proportionately to the
growth of capacity.
Statistical certificates
The obliged suppliers may apply for issuing certificates
of origin regarding the purchase of energy produced in
micro- and small installations. The correction rate for the
energy produced from this kind of sources is to amount
to 0,005.
RES payment
There was introduced a new instrument, that is the
RES payment. It aims at covering the costs of energy
operators, which costs stem from the purchase of energy
produced in micro- and small RES installations at a price
that is higher than the market selling price of energy.
A payer to the RES payment shall collect from the ultimate
consumer the “Ultimate RES Payment”. In 2013, the rate is
to amount to PLN 0,60813510 for 1 MWh.
