zagospodarowania przestrzennego. Te zmiany, po
prawie dwóch latach, przyniosły efekt. Zmiana prawa
pozwoliła na zmniejszenie wolumenu wnioskowanych
przyłączeń farm wiatrowych do ok. 5,3 GW 16 nierozpatrzonych
wniosków na 29 czerwca 2012 r.
Na zmniejszenie liczby wniosków wpłynął też
obowiązek przedłożenia wraz z wnioskiem tytułu
prawnego do nieruchomości, na której ma być posadowiona
farma wiatrowa. Należy jednak wskazać,
że mechanizm zaliczkowy nie wyeliminował zjawiska
spekulacji, a jedynie pozbawił tej możliwości małych
uczestników rynku. Mankamentem istniejącego
systemu rozpatrywania wniosków jest także to, że
nie uwzględnia się stopnia zawansowania projektu,
podczas gdy z punktu widzenia rozwoju rynku energetyki
wiatrowej faworyzowane powinny być projekty
bardziej zaawansowane i oferujące wyższe prawdopodobieństwo
realizacji inwestycji.
Pozytywnie należy ocenić jednak wprowadzenie
30 października 2011 r. zasady „wykorzystaj lub
utrać” („use or loose it”), która powoduje wygaśnięcie
warunków przyłączenia, jeżeli umowa przyłączeniowa
nie zostanie zawarta w ciągu dwóch lat (art. 7 ust. 8i
ustawy Prawo energetyczne).

The lowering of the number of applications also
resulted from the requirement that the application be
accompanied by the legal title to the property where
the wind farm was to be located. However, it must be
noted that despite a substantial drop in the number of
submitted applications, that number still remains very
high. The advance fee mechanism did not eliminate
the speculation, but only deprived small market players
of that option. Another flaw of the existing application
examination system lies the fact that the degree of
project advancement is not taken into consideration,
whereas from the point of view of development of wind
energy market, the selection process should favor
projects that are more technologically advanced and
that offer a higher probability of investment completion.
On the other hand, the “Use It Or Lose It” rule
introduced on 30 October 2011 as a result of which
the connection terms will expire if the grid connection
agreement is not concluded within two years (Article 7
Section 8 of the Energy Law Act) should be perceived
as a positive development.
