Obszary chronione<br />
Protected areas<br />
Istotną barierą dla rozwoju energetyki wiatrowej<br />
jest występowanie i systematyczne powiększanie<br />
obszarów objętych programem Natura 2000. Według<br />
oficjalnych danych w <strong>Polsce</strong> sieć Natura 2000<br />
zajmuje 19,4% 26 powierzchni lądowej kraju. W jej skład<br />
wchodzą 823 obszary siedliskowe mające znaczenie<br />
dla Wspólnoty oraz 145 obszarów specjalnej<br />
ochrony ptaków, które pokrywają odpowiednio<br />
11% i 15,8% powierzchni lądowej Polski (niektóre<br />
obszary się pokrywają). Według danych GUS całość<br />
obszarów chronionych w <strong>Polsce</strong> wynosi około 32,4%<br />
powierzchni kraju (bez obszarów Natura 2000) 27 .<br />
Inwestycje na terenach, które zostaną w przyszłości<br />
objęte programem, mogą napotkać na utrudnienia<br />
formalno-prawne, a w skrajnym przypadku, mogą<br />
zostać wstrzymane. Takim ryzykiem obarczone są też<br />
projekty lokalizowane w otul<strong>in</strong>ach i <strong>in</strong>nych terenach<br />
sąsiadujących z obszarami chronionymi. Regionalna<br />
Dyrekcja Ochrony Środowiska może bowiem uznać,<br />
że farma <strong>wiatrowa</strong> ma istotny negatywny wpływ na<br />
obszar chroniony, mimo iż jest usytuowana poza<br />
jego terenem. Pojawiają się zatem postulaty o jak<br />
najszybsze przyjęcie ostatecznej obowiązującej listy<br />
obszarów objętych programem Natura 2000. Komisja<br />
Europejska sugeruje, aby uzupełnienie obszaru<br />
objętego programem, zgodnie z rezolucją Parlamentu<br />
Europejskiego 28 , zakończyło się w 2012 r.<br />

Chapter X is particularly <strong>in</strong>terest<strong>in</strong>g, as it discusses<br />
the issue of good practice <strong>in</strong> the area of predict<strong>in</strong>g the<br />
impact of a w<strong>in</strong>d farm on the environment.<br />
The existence and consistent expansion of the<br />
areas covered by Natura 2000 program constitutes<br />
a considerable obstacle to the establishment of<br />
w<strong>in</strong>d farms Accord<strong>in</strong>g to the official data, the Natura<br />
2000 network <strong>in</strong> <strong>Poland</strong> covers 19.4% 26 of the land<br />
territory of the country. It comprises 823 habitat sites<br />
of Community importance, and 145 special bird<br />
protection zones that cover respectively 11% and 15.8%<br />
of the land territory of <strong>Poland</strong> (with some of these<br />
areas overlapp<strong>in</strong>g). Accord<strong>in</strong>g to the Central Statistical<br />
Office data, the total protected area <strong>in</strong> <strong>Poland</strong> covers<br />
about 32.4% 27 of the territory of the country (exclud<strong>in</strong>g<br />
Natura 2000 areas). Investments <strong>in</strong> the areas to be<br />
covered by the program <strong>in</strong> the future may encounter<br />
formal and legal obstacles or, <strong>in</strong> extreme cases,<br />
may have to be put on hold. Similar risk is <strong>in</strong>volved<br />
<strong>in</strong> case of projects located <strong>in</strong> buffer zones and other<br />
areas adjacent to the protected zones. The Regional<br />
Directorate for Environmental Protection may decide<br />
that a w<strong>in</strong>d farm has a considerate negative impact on<br />
a protected area despite it be<strong>in</strong>g situated outside that<br />
area. Therefore, demands are made to adopt the f<strong>in</strong>al<br />
b<strong>in</strong>d<strong>in</strong>g list of areas covered by Natura 2000 program<br />
as soon as possible. The European Commission<br />
suggests that supplement<strong>in</strong>g the area covered by the<br />
program, accord<strong>in</strong>g to the resolution of the European<br />
Parliament, 28 should be concluded <strong>in</strong> 2012.<br />
A w<strong>in</strong>d farm is qualified as a Group II <strong>in</strong>vestment<br />
(i.e. one with potential material environmental<br />
impact).<br />
