o współczynniki zróżnicowane dla różnych technologii
wytwarzania energii. Zmiana systemu nastąpi
prawdopodobnie już w 2013 r. To przyspieszenie
w głównej mierze zawdzięczamy gwałtownemu
wyhamowaniu rozwoju rynku OZE w warunkach
obecnie istniejącego systemu wsparcia, którego
czasowy horyzont (2017) okazał się już w 2011 zbyt
krótki, przede wszystkim z punktu widzenia zarządzania
ryzykiem kredytowym instytucji finansujących
projekty inwestycyjne. M.in. z tych względów,
a także z uwagi na konieczność transponowania
celów dyrektywy 2009/28/WE w sprawie promowania
stosowania energii ze źródeł odnawialnych,
od grudnia 2011 prowadzone są intensywne prace
nad projektem ustawy o OZE, której wejście w życie
planuje się na rok 2013.
Z punktu widzenia państwa, najważniejszym celem
projektu ustawy o OZE w jego ostatnim kształcie 38
znanym autorom raportu na moment oddania
do druku niniejszej publikacji, jest zróżnicowanie
wsparcia dla różnych technologii w sposób umożliwiający
adekwatną stymulację ich rozwoju. Obecne
certyfikaty bez współczynników (lub inaczej: ze
współczynnikiem = 1,0) oferują wprawdzie wystarczający
poziom finansowania inwestycji wiatrowych,
przy okazji jednak nadmiernie faworyzują współspalanie
biomasy, a jednocześnie są zdecydowanie
niewystarczające dla uruchomienia przemysłowych
inwestycji w źródła fotowoltaiczne. Z kolei
z perspektywy deweloperów czy inwestorów, a także
banków finansujących, głównym elementem nowego
modelu jest 15-letni okres gwarancji utrzymania
warunków wparcia ustalonych dla danego projektu
w pierwszym roku jego eksploatacji. Przez ten okres
sprzedawca z urzędu (zakład energetyczny) miałby
obowiązek zakupu energii po stałej cenie, jednak
nie dłużej niż do 31 grudnia 2035 r. Tej stałości
brakuje obecnemu modelowi, przez co fakt relatywnie
wysokich przychodów ze sprzedaży możliwych
do uzyskania np. w roku 2012 nie przekłada
się na przewidywalność i bezpieczeństwo inwestowania
nie tylko w długim ale nawet w średnim
okresie. Nie jest znana bowiem ani cena minimalna
odbioru energii tzw. czarnej, jaką regulator określi
na rok 2013 i późniejsze, ani tym bardziej nie ma
pewności co do cen zielonych certyfikatów, na które
wpływ ma nie tylko opłata zastępcza ustalana co rok
przez URE (także nieznana), ale także inne czynniki,
w tym głównie mechanizmy rynkowe, czyli podaż
certyfikatów.
Według projektu ustawy o OZE wsparcie dla
poszczególnych OZE kształtować ma się
następująco:

not going to be the case, and that the future support
scheme will still be based on certificates of origin
corrected by rates diversified according to various
energy generation technologies. The system will
most probably change as early as 2013. That faster
pace of changes has been primarily triggered by
a sudden slowdown in the RES market development
that occurred under the circumstances of the
existing support system whose time horizon (2017)
turned out to be too short already in 2011, mainly
from the point of view of managing credit risk of
investment financing institutions. For those reasons,
among others, as well as because of the obligation
to transpose the goals set up by the Directive
2009/28/EC on the promotion of use of energy from
renewable sources, intense work has been done
since December 2011 on the bill of the RES Act
which is expected to come into effect in 2013.
As far as the State is concerned, the key goal of the
latest draft of the RES Act 38 available to the authors
as of the print date of this report is to diversify
support for various technologies in the way
ensuring adequate stimulation of their development.
While the existing certificates that are rate-free (or
rather: assigned a rate of 1.0) do offer a sufficient
degree of wind investment financing, they still
excessively favor the biomass co-combustion
while at the same time being definitely insufficient
to trigger industrial investments in photovoltaic
sources. In turn, for developers or investors, as
well as financing banks, the focal point of the new
model is the 15-year guarantee for the support
terms granted for a specific project during the first
year of use. Throughout that period, the supplier of
last resort
(power plant) would be obliged to purchase power
at a fi xed price; however, only until 31 December
2035. This stability is missing from the existing
scheme and, consequently, a relatively high sales
income that can be achieved e.g. in 2012 does not
actually translate to the investment predictability
and security in a long-term or even mediumterm
perspective. This is caused by a lack of any
indication as to a minimum collection price of the
so-called black energy to be set by the regulatory
authority for 2013 and subsequent years, and by
a lack of certainty regarding green certificate prices
that are affected not only by the substitution fee set
annually by the Energy Regulatory Office (which
is also unknown) but also by other rates, including
in particular market mechanisms i.e. supply of
certificates.
According to the bill of the RES Act, support for
individual RES should be as follows:
