Ograniczenia przyłączeniowe wynikające z planów rozwojowych operatorów
Connection limitations arising from operators’ development plans
Prawo energetyczne nakłada na dystrybutorów
energii elektrycznej obowiązek sporządzania planów
rozwoju w zakresie zaspokojenia obecnego i przyszłego
zapotrzebowania na energię w co najmniej
trzyletniej perspektywie. W przypadku operatora
systemu elektroenergetycznego okres ten nie może
być krótszy niż pięć lat. Ponadto operatorzy zobowiązani
są sporządzać prognozy dotyczące stanu
bezpieczeństwa dostaw energii elektrycznej na
okresy nie krótsze niż piętnaście lat. Projekty planów
rozwoju uzgadnianie są z Prezesem URE. Jest to
główne narzędzie realizacji polityki energetycznej
państwa. Plany te kontrolowane są m.in. w zakresie
zgodności z miejscowym planem zagospodarowania
przestrzennego (albo kierunkami rozwoju gmin
określonych w studiach uwarunkowań i kierunków
zagospodarowania przestrzennego) oraz stopniem
realizacji planów zaopatrzenia w energię uchwalanych
przez rady gmin. Niestety gminy nie wykazują
dużej aktywności w zakresie umieszczania OZE
w ramach tych dokumentacji. Co więcej, na poziomie
ponadlokalnym brak jest współpracy i koordynacji
działań pomiędzy samymi OSD oraz OSP, co
skutkuje brakiem spójnego działania w zakresie
rozbudowy systemu elektroenergetycznego. W tym
zakresie wydaje się, że Prezes URE powinien sprawniej
wykorzystywać istniejące mechanizmy prawne
pozwalające na zrównoważony rozwój sieci. W praktyce
operatorzy nierzadko wykorzystują własne plany
jako uzasadnienie odmowy lub opóźnienia przyłączenia
elektrowni wiatrowych, np. jeżeli zaplanowane
inwestycje dotyczą innych lokalizacji lub innego
zakresu.
Naruszenie dyrektywy 2009/28/WE
Violation of Directive 2009/28/EC
Zgodnie z treścią Dyrektywy 2009/28/WE Polska
powinna była implementować ją do prawa krajowego
i notyfikować w Komisji UE do 5 grudnia 2010 roku.
Do końca września 2012 r. opracowano jedynie
projekty stosownych ustaw, a ich los w parlamencie
nie jest jeszcze przesądzony. Komisja Europejska
w marcu 2012 r. w oficjalnym komunikacie ogłosiła,
że wystosowała „uzasadnione opinie” do Finlandii,
Grecji i Polski zastrzegając, że jeżeli w ciągu
2 miesięcy te kraje nie wywiążą się z obowiązku
implementacyjnego sprawa może zostać przekazana
do Trybunału Sprawiedliwości Unii Europejskiej, co
będzie oznaczać dotkliwe sankcje finansowe za każdy
dzień zwłoki we wdrożeniu wskazanej dyrektywy.
Przedstawiciele rządu zapewniają, że ustawy implementujące
dyrektywę zostaną uchwalone do końca
roku 2012.
The Energy Law requires electricity distributors to
draw up development plans with regard to satisfying
the existing and future demand for energy in the
perspective of at least 3 years. In case of power
system operators, that timeframe must be at least five
years. Moreover, operators are required to develop
forecasts with regard to security of electricity supply
for the period of not less than fifteen years. By
principle, development plan drafts are consulted with
the President of the Energy Regulatory Office. They
constitute the key instrument for implementation of the
national energy policy. The plans are inspected with
regard to, among others, their conformance to the local
land development plan (or commune development
directions defined in land development conditions and
directions studies), and the degree of completion of
energy supply plans adopted by commune councils.
Unfortunately, municipalities do not tend to actively
incorporate RES in those documents. Besides,
cooperation and coordination between distribution
network operators (DNO) and transmission network
operators (TNO) fails on a supralocal level, which leads
to inconsistent actions regarding development of the
power grid. To this end, it seems like the President of
the ERO should exercise more efficiently the existing
legal mechanisms that facilitate sustainable growth
of the grid. In practice, operators often use their own
plans as a basis to refuse or delay connection of wind
farms, e.g. if investments are planned in respect of
different locations or scope of works.
Pursuant to the wording of the Directive 2009/28/
EC, Poland should have implemented the Directive
into the national law and notified the same to the EU
Commission by 5 December 2010. By the end of
September 2012 only bills of respective legal acts
have been drafted, and it is still uncertain what fate
they are going to face in the parliament. In March
2012 the European Commission announced in an
official communication that it had issued “reasoned
opinions” to Finland, Greece and Poland, and it
reserved that should those countries fail to meet the
implementation obligation within 2 months, the case
may be referred to the EU Court of Justice, which in
turn may entail severe financial sanctions for each day
of delay in implementing the said directive. Government
representatives assure that legal acts implementing the
directive will be adopted by the end of 2012.
