Chapter IV
On courts and offices established during the period of lack of freedom

Article 13
(1) The government shall stipulate by decree which of the courts and administrative authorities established
during the period of lack of freedom shall carry out their business for a temporary period, and to what extent.
(2) The records of those courts and administrative authorities, established during the period of lack of
freedom to implement the judicial system and public administration on the territory of the Czechoslovak
Republic, on which a decision has not been made in accordance with the previous paragraph, shall be handed
over without delay to the Czechoslovak court or office that has jurisdiction for the subject-matter and
territory of the case.
Chapter V
Final provisions
Article 14
(1) This constitutional decree shall come into force on the day of promulgation and for the time being
shall be valid only in the Bohemian and Moravo-Silesian provinces.
(2) The government empowers itself to lay down by decree that the provisions of this constitutional
decree including its provisions shall also be valid in Slovakia.
(3) This constitutional decree shall be enforced by all members of the government.

1945, May 19, Prague – Decree of the President of the Republic No. 5/1945 on the Invalidity of Certain
Property Transactions at the Time of Loss of Freedom and on the National Administration of the Property
Assets of Germans, Hungarians, Traitors and Other Collaborators and Certain Organisations and
Institutions.
On a proposal from the government I decree that:
Article 1
(1) Any kind of property transfer whatever and any kind of property transaction, whether relating to
immovable or moveable, public or private property, is null and void if it occurred after the September 29,
1938 under the pressure of the Occupation or of national, racial or political persecution.
(2) Where not covered in this decree, the manner in which claims arising from the provisions of
Paragraph I are to be asserted will be regulated by special decree of the President of the Republic.
Article 2
(1) The property of persons unreliable in relation to the state on the territory of the Czechoslovak
Republic is taken under national administration in accordance with other provisions of this decree.
(2) Property of persons unreliable in relation to the state is to be understood to include property
disposed of by such persons after the September 29, 1938, unless the acquirer was unaware that the
property was of this kind.
Article 3
Enterprises (factories) and properties will be taken under national administration where the
uninterrupted operation of production and economic life requires it, specifically in factories, enterprises
and properties that have been abandoned, or in such properties as are in the possession of, administered,
rented or leased by persons unreliable in relation to the state.
Article 4
The following are to be considered persons unreliable in relation to the state is meant:
a) persons of German or Hungarian nationality,
b) persons who have engaged in activities aimed against the state sovereignty, independence, integrity,
democratic-republican state form, security and defence of the Czechoslovak Republic, who have incited
or sought to seduce other persons to such activity, and who have in any way deliberately supported the
German and Hungarian occupiers. Persons who may be so defined include, for example, members of
Vlajka, Rodobrana, the assault corps of the Hlinka Guard, leading officials of the Association for Cooperation
with the Germans, the Czech League against Bolshevism, the Youth Education Board, the
Hlinka Slovak People’s Party, the Hlinka Guard, the Hlinka Youth, the National Employees’ Trade
