the Decree of the President of the Republic of June 19, 1945, No. 16 Coll., concerning punishment of Nazi
criminals, traitors and their accomplices and concerning special people’s courts) preferred Germanisation or
Hungarianisation of the territories of the Czechoslovak Republic, or behaved with hostility to the
Czechoslovak Republic or to the Czech and Slovak nation, and also persons who allowed such activity by
persons who were administering their property or business.
(2) Provisions of Para. 1, number 3, also apply to legal entities if it is possible to allocate the guilt for the
way this business behaved to the physical persons who are the members or shareholders of the property or
business (capital participants) that represented the legal entity, or if these persons failed to exercise
appropriate care during its decision-making or their supervision of it.
(3) All that property is also confiscated which in the period after September 29, 1938, belonged to the
subjects named in Paras. 1 and 2, and during this decisive period was, in accordance with Para. 1,
sentence 1, and actually as the case may be still is, in the ownership of those persons in whose hands it
would not fall to confiscation, except where the putting of this property up for confiscation would not
follow principles of common decency.
(4) Whether all the requirements for confiscation are fulfilled in accordance with this decree will be decided
by the relevant District National Committee. The decision can be delivered by public announcement, even
when all the requirements of Para. 33 of the government directive of January 13, 1928, No. 8 Coll.,
concerning proceedings taken in matters concerning the activity of political offices (administrative hearings)
are not fulfilled. The decision of the District National Committee can be appealed at the Provincial
National Committee (in Slovakia at the relevant agency of the Slovak National Council). The Provincial
National Committee (in Slovakia the relevant agency of the Slovak National Council) can take over the
proceedings even while they are in session, and decide the matter in the first instance. If the decision is
taken in the first instance by the Provincial National Committee (in Slovakia the relevant agency of the
Slovak National Council) this decision can be appealed at the Ministry of the Interior. The Minister of the
Interior can, in accordance with this paragraph, adjust this decision process further through directives.
Article 2
Exemptions from confiscation and rendering of compensation:
(1) From confiscation are exempted those chattels of the persons named in Article 1, Para. 1, Numbers 2
and 3, which are absolutely necessary for sustaining the necessities of life, or for personally carrying on
the employment of these persons and members of their families (such as clothing, bedding, linen, home
equipment, food and tools). Details as to the size and extent of this property are given in a directive of
the government.
(2) The government can decide by a directive that the property of a certain group of persons who fall
under the provisions of Article 1 is partly or completely excluded from confiscation.
(3) Property is not to be confiscated which after September 29, 1938, under pressure of occupation, or
as a result of national, racial or political persecution, was lost by persons who do not fall under the
provisions of Article 1.
(4) During the confiscation of the property of a legal entity there is a right of appropriate compensation
for the persons who had capital participation in it if they do not fall under the provisions of Article 1,
Paras. 1 and 2. Details will be regulated by government directive.
(5) If persons whose property falls to confiscation are co-owners with persons who do not fall under the
provisions of Article 1, and if their co-ownership/share is more than one half, the entire property will be
confiscated. To persons not falling under the provisions of Article 1, compensation is due, in this case of
the same value as was their share, or if that is not possible, then in cash.

Transfer of real estate and deeds of title to the State.
Transfer to the Czechoslovak state of real estate and deeds that will not be allocated to other persons
will be registered in the court of the Land Registry in the public record upon the proposal
