Article 11
National administration will be terminated as soon as the reasons for its imposition cease to exist. It will
be terminated by the same body that introduced it.
Article 12
(1) All co-operative concerns and organisations (agricultural, retail, financial and suchlike) are to be
taken under temporary national administration. This national administration will secure the ordinary
running of the concern for a period of up to 4 weeks, and the election of a new managing body.
(2) Local National Committees will impose this temporary national administration on co-operatives that
do not operate the local ward limits; District National Committees will impose it in the case of cooperatives
that operate beyond ward limits, but not the limits of the district, and in all other cases it will
be imposed by the Provincial National Committee, and in Slovakia by the Slovak National Council.
(3) Before imposition of temporary national administration the views of the members of the cooperative
should be heard as far as circumstances allow.
(4)Temporary national administration will end as soon as the membership of the co-operative elects
a new management.
Article 13
The appropriate Provincial National Committee, and in Slovakia the Slovak National Council, may
also impose national administration on professional, economic, cultural and interest-group
organisations and institutes when there is good reason to do so.
Article 14
(1) Decisions on the imposition and termination of national administration, and on the appointment
and dismissal of national administrators, must be issued in writing.
(2) A copy of the decision is to be delivered to the Provincial National Committee, and in Slovakia
the Slovak National Council.
Article 15
On the basis of a decision under Article 14, the change will be registered ex officio by the relevant
courts as follows:
a) In the case of immovable property the relevant court will enter a record of statement of national
administration in the land register books,
b) In the case of mining licences the relevant court or office will enter a record of statement of
national administration in the mining land books, or registers,
c) in the case of concerns (factories) registered in the commercial (company) and in Slovakia the firm
register, the relevant court will make enter a record of the statement of national administration in the
commercial (company) register, and in Slovakia in the firm register.
Article 16
(1) Only a person with the requisite expert and practical knowledge, morally unimpeachable and
reliable in relation to the state may be appointed a national administrator.
(2) As a rule, no debtor or creditor of the concern (factory) or property estate should be appointed as
national administrator, unless the organ competent under Article 7 decides otherwise.
(3) As a rule the national administration will be appointed from among capable employees of the
concern in question.
(4) A member of the National Committee competent to introduce national administration under
Article 7 may not be appointed a national administrator.
Article 17
(1) In the case of smaller properties, small businesses, small trades operators and such like, one
administrator may be appointed for more than one concern or property estate.
(2) If the scale of national administration so requires, a body competent under Article 7 may appoint
a committee of up to 5 members which will then manage the administration on the principle of
majority vote.
Article 18
Before taking up their office, national administrators will make a promise to the body competent
under Article 7 to the effect that they will conscientiously fulfil their duties with the care of a proper
steward in accordance with economic, national and other public interests.
Article 19
In the performance of their function national administrators possess the status of public organs within
the meaning of Article 68 of the criminal law code of the May 27, 1852, No. 117 imp. law., Article
461 of the legal code, Article V/1878, and Article 5 of the legal code, Article XI/1914.
