Article 8
(1) Applicants will pay the specified reimbursement (Article 7) in accordance with their economic
potential: a) in full settlement, at the latest twelve months from taking possession of the allocation, in
cash or kind, or b) in payments in cash or kind, as follows: 10% payment is to be paid upon taking
possession of the allocated land. If proposed by the District National Committee (District
Administrative Commission), in accordance with the report of the Area Agricultural Commission, the
National Land Fund can postpone the first payment at the most for three years; the final payment is due
in accordance with the payment plan specified by the National Land Fund at the latest fifteen years
from the day of taking possession of the allocated property.
(2) In exceptional cases of special need, or where it is socially justified, the National Land Fund can,
after examination of the case and with the co-operation of the relevant National Committee and the
Agricultural Commission, excuse payment by the recipient and give appropriate agricultural land
without payment primarily to those listed in Article 3.
Article 9
The reimbursement is paid by the recipients to the National Land Fund (Article 7), and will be used to
pay the debts and obligations attached to the confiscated properties, if these debts and obligations are
recognised and assumed, and also for payment for war damages and damages inflicted on the property of
persons persecuted during the period of occupation for national, political or racial reasons, and also for
the improvement of agricultural production and for internal relocation. If there is any excess in the
National Land Fund, it will fall to the state coffers.
Article 10
(1) In the reimbursement determined in accordance with Article 7 are included all expenses and
payments incurred during the confiscation and allocation of the land, including the transfer of the
property to the National Land Fund [Article 2, Para. 2, Letter (b)], the train transport of the recipients
and their families and their inventories to the location of their allocated land, the registration of the
transfer of the allocated property and through the exchange of the returned property.
(2) Recording of the allocations in the Land Registry necessary for the implementation of the allocation
and for the return of the land [Article 2, Para. 1, Letter (b)] will be carried out by
the National Land Fund.
(3) Transfers of ownership executed in accordance with this decree and the associated handing over to
the courts and offices are free from payments, taxes and duty.
Article 11
The government is empowered to secure the necessary financial means for the execution
of internal relocation.
Article 12
This decree becomes law in Czech lands on the day of publication; it will be executed by the
Ministry of Agriculture in consultation with the Ministers of Finance, Interior, Justice, Transport
and Food.

1945, July 31, Prague – Decree of the President of the Republic 38/1945 Coll., Concerning Strict
Punishment for Looting.
The government proposes, and after consultation with the Slovak National Council, I decree that:
Article 1
Whoever, taking advantage of the exceptional conditions created by war or after the state of war, will
take for themselves or other unauthorised persons the possessions or chattels of not insignificant value
belonging to others which are in the buildings, or rooms, or on property deserted by the owner or
damaged by whatsoever act of war, such as aerial or terrestrial bombardment, will be deemed to
commit looting, and will be punished for this crime by hard labour from 5 to 10 years. If the
