The Provisional National Assembly of the Czechoslovak Republic has agreed to the following constitutional law: Article 1 (1) The Provisional National Assembly confirms and enacts as law the Constitutional Decrees and Decrees of the President of the Republic published on the basis of Article 2 of the Constitutional Decree of the President of the Republic from October 15, 1940, No. 2 Official Czechoslovak Gazette (20/1945 Coll.), concerning the interim exercise of constitutional power, including the present constitutional decree if it has not already taken effect. (2) All decrees of the President of the Republic are to be considered law from their inception, and constitutional decrees will also be considered constitutional laws. (3) Territorial and temporal validity of these regulations listed in previous paragraphs remains without change. Article 2 We hereby effect and change Article 5, Paras. 1 and 2 of the Constitutional Decree of the President of the Republic from August 3, 1944, Article II, Official Czechoslovak Gazette, concerning the reestablishment of legal order in the text of the law from December 19, 1945, No. 12 Coll., from the year 1946, by which we confirm, add to and change the regulations concerning the renewal of constitutional order. Article 3 (1) The Constitutional Decree and the Decrees of the President of the Republic listed in Article 1 will be published within eighteen months as an addition to the Collection of the Laws and Directives of the Czechoslovak Republic if they have not already been printed in this Collection. The Provisional National Assembly of Czechoslovak Republic has agreed on the following law: Article 1 Actions that occurred between September 30, 1938 and October 28, 1945, with the purpose of assisting the struggle for renewal of the freedom of Czechs and Slovaks, or which were directed to just retribution for the acts of the occupying forces and their accomplices, are not unlawful even when they would be so according to the criminal code in effect at that time. Article 2 (1) Persons convicted for this kind of criminal activity are to be dealt with in accordance with the directives on re-opening criminal proceedings. 330
(2) The relevant court is the court of first instance and, if it does not exist, then the court which would now be the appropriate court of first instance if the illegality of the act were not ruled out in accordance with Article 1. (3) If the action listed in Article 1 is linked with a criminal act for which the accused was convicted as part of the same sentence, the court will render new judgement for this other criminal act, taking into account the guilty verdict already reached.
