this need and from this dissent came the new idea <strong>of</strong> constitutional protection for<br />

freedom <strong>of</strong> the press.<br />

<strong>The</strong> mean<strong>in</strong>g <strong>of</strong> this right has always been—and rema<strong>in</strong>s to this day—highly<br />

contested. <strong>The</strong> application <strong>of</strong> press freedom has never been as unqualified as<br />

Supreme Court Justice Hugo Black or other absolutists would want. Mob action<br />

limited press freedom dur<strong>in</strong>g the Revolution, and the federal Sedition Act <strong>of</strong> 1798<br />

banned exactly the type <strong>of</strong> criticism <strong>of</strong> government that appeared to <strong>in</strong>spire the idea<br />

<strong>of</strong> protect<strong>in</strong>g the freedom <strong>of</strong> the press <strong>in</strong> Virg<strong>in</strong>ia. Federalists defended the Sedition<br />

Act by po<strong>in</strong>t<strong>in</strong>g to Blackstone’s limited def<strong>in</strong>ition, while Republicans argued it was<br />

<strong>in</strong>consistent with the First Amendment’s guarantee <strong>of</strong> freedom <strong>of</strong> the press. <strong>The</strong><br />

act expired <strong>in</strong> 1801, but certa<strong>in</strong>ly the threats aga<strong>in</strong>st free press did not end there. 10<br />

Dur<strong>in</strong>g times <strong>of</strong> war and crisis, freedom <strong>of</strong> expression cont<strong>in</strong>ues to be threatened.<br />

This work focused on liberty <strong>of</strong> the press <strong>in</strong> a specific time and place, hav<strong>in</strong>g<br />

the disadvantage <strong>of</strong> not be<strong>in</strong>g able to apply the f<strong>in</strong>d<strong>in</strong>gs more widely, and hav<strong>in</strong>g<br />

the advantage <strong>of</strong> greater detail, depth, and knowledge <strong>of</strong> the specifics. By closely<br />

exam<strong>in</strong><strong>in</strong>g colonial Virg<strong>in</strong>ia, and to some extent neighbor<strong>in</strong>g Maryland, it is evident<br />

<strong>in</strong> the public pr<strong>in</strong>ts, the political battles, and the legal cases how freedom <strong>of</strong> the<br />

press developed over time and was preserved by the public. Close focus br<strong>in</strong>gs a<br />

more complete understand<strong>in</strong>g <strong>of</strong> the concept <strong>in</strong> that time and place. Because the<br />

Virg<strong>in</strong>ia constitutional protection <strong>of</strong> the press <strong>in</strong>spired other states, and because,<br />

both directly and <strong>in</strong>directly—through the other state constitutions—it was the key<br />

precedent for the First Amendment, this study does give us greater understand<strong>in</strong>g<br />

about the larger federal protection.<br />

A critical legal protection such as freedom <strong>of</strong> the press can develop from<br />

more egalitarian sources than political theory or accepted legal practice. <strong>The</strong> public<br />

pr<strong>in</strong>ts <strong>of</strong> both Maryland and Virg<strong>in</strong>ia displayed clear calls for press freedom. This<br />
