Sultan v. Gitman<br />
Facts:<br />
Gitman covered up an oil spill in his basement with fresh<br />
concrete and then sold his house to Sultan.<br />
Gitman drafted a clause in the offer and deed of sale<br />
purporting to exclude legal warranty.<br />
The offer stipulated that the sale was "made without any<br />
warranty whatsoever, it being added for greater certainty,<br />
that we take the immovable, equipment and accessories asis<br />
and without any warranty as to latent defects".<br />
