Sultan v. Gitman Facts: Gitman covered up an oil spill in his basement with fresh concrete and then sold his house to Sultan. Gitman drafted a clause in the offer and deed of sale purporting to exclude legal warranty. The offer stipulated that the sale was "made without any warranty whatsoever, it being added for greater certainty, that we take the immovable, equipment and accessories asis and without any warranty as to latent defects". 80
Sultan v. Gitman The clause in the deed of sale read: "Warranty This sale is made without legal warranty.", with the following words which had been added in by hand by Gitman on a previous draft: "and without warranty as to latent defects". 81
