Provigo Distribution inc. v. 9173-1588 Québec inc. (Court of<br />
Appeal, February 12, 2012)<br />
Decision is important for 2 reasons:<br />
(1) Court reaffirmed its 2001 decision in Épiciers unis Métro-<br />
Richelieu inc. v. Standard Life Assurance Co. that<br />
commercial use restrictions are not real servitudes.<br />
(2) Court concluded that a change in zoning is akin to force<br />
majeure and can frustrate contractual obligations.<br />
