THE ISSUE OF PUBLICATION AGRECEMENT SUBJECTS
STATUS CONCEPTION IN GERGIAN LEGISTATION
Copyright legislation effective in Georgia does not contain the
concept of publication agreements, status of the publication agreement
subjects. At current stage this omission causes significant problems as
number of the publishing houses and of the authors increase in Georgia,
what should become the basis for successful future of the printed books,
entry of Georgian authors and publishers to the international book market.
Practice of publishing activities requires detailing of these issues in
the legislation and therefore this problem is significant and it could be
solved via complex approach including the theoretical and practical issues
in the given sphere. Goal of the work is support to development of the
relevant legislative base in Georgia and elaboration of the unified conception
of the publishing activities in legal aspect.
Based on the experience of the countries with different legal systems,
as well as practical necessity the following would be reasonable: 1.
Georgian Law on Copyright and Related Rights should define the concept
of standard agreement in the copyright sphere and the circle of subjects;
2. special law on publishing activities should be adopted, which
would provide detailed regulation of the relations in the publishing sphere,
status of the subjects and their rights and obligations.
