PUBLIC HOLIDAYS AMENDMENT BILL 2011<br />

The DEPUTY PRESIDENT — Order! I remind<br />
members who join the minister at the table that they can<br />
speak but need to do so from their place.<br />
Mr SOMYUREK (South Eastern Metropolitan) —<br />
Can the minister advise the house on which<br />
stakeholders the government consulted with prior to the<br />
formulation <strong>of</strong> this bill?<br />
Hon. R. A. DALLA-RIVA (Minister for<br />
Employment and Industrial Relations) — I thank the<br />
member for his question. The bill implements our<br />
election commitments by restoring to country<br />
<strong>Victoria</strong>ns their ability to celebrate their local show<br />
days and race days with their local public in lieu <strong>of</strong><br />
Melbourne Cup Day, with the flexibility to do as they<br />
choose.<br />
Firstly, there was our election commitment, which is on<br />
the public record; and secondly, there were press<br />
releases dated 30 September 2009 and 16 December<br />
2009 that were released by the then Deputy Leader <strong>of</strong><br />
the Opposition and shadow Minister for Small<br />
Business. So it has been out there. And I have been led<br />
to believe by my honourable colleague next to me that<br />
the minister has written to the councils seeking<br />
comments from them.<br />
Mr SOMYUREK (South Eastern Metropolitan) —<br />
What briefings has the minister had with respect to the<br />
impacts this legislation will have on small and<br />
medium-size businesses?<br />
Hon. R. A. DALLA-RIVA (Minister for<br />
Employment and Industrial Relations) — I thank<br />
Mr Somyurek for his question. The impact this<br />
legislation will have on businesses has been noted.<br />
There has been some documentation <strong>of</strong> this in the<br />
Weekly Times, and I am happy to provide the member<br />
with that after the committee hearing. On 14 October<br />
2009, for example, there were concerns about the<br />
people <strong>of</strong> Warracknabeal putting on a brave face,<br />
despite the fact that their recently held local show was<br />
much quieter than usual. This legislative change <strong>of</strong>fers<br />
the flexibility for non-metropolitan councils to do as<br />
they choose in terms <strong>of</strong> local show days and race days.<br />
What has been found is that businesses are suffering.<br />
There is confusion and a lack <strong>of</strong> capacity to have<br />
part-day holidays, two half-day holidays or part-shire<br />
holidays, so this legislation will make it easier for<br />
businesses to work and not undergo suffering. Equally,<br />
it appears that the current structure, which was created<br />
by the former government, made it difficult for large<br />
shires to have a show in one part <strong>of</strong> the shire on one day<br />
and a second in another part on a separate day. Councils<br />
basically had to make a choice as to which show they<br />
would hold in lieu <strong>of</strong> Melbourne Cup Day.<br />
In our view what this legislation does is allow local and<br />
regional councils the ability to make arrangements for<br />
either half-day or part-shire holidays in lieu <strong>of</strong> the<br />
Melbourne Cup holiday. We think this will allow<br />
greater flexibility for businesses in their capacity to<br />
operate.<br />
Mr SOMYUREK (South Eastern Metropolitan) —<br />
I thank the minister for his answer. The minister spoke<br />
about half-days. Surely the proliferation <strong>of</strong> half-days<br />
will have some impact on the regulatory burden faced<br />
by small and medium-size businesses? Has the minister<br />
had a briefing as to the potential impacts <strong>of</strong> half-day<br />
holidays on small and medium-size businesses?<br />
The DEPUTY PRESIDENT — Order! I have<br />
called clause 1 only for the purpose <strong>of</strong> the bill.<br />
Mr Somyurek is asking about issues which relate more<br />
directly to clause 3. I am happy to allow that question if<br />
the minister wants to answer it or hold it over until<br />
clause 3. But other members are wanting to speak on<br />
clause 1, so I am trying to keep some order in the<br />
debate. Would the minister like to respond to that<br />
question or hold it over until clause 3?<br />
Hon. R. A. DALLA-RIVA (Minister for<br />
Employment and Industrial Relations) — No, I was<br />
going to say the issues relate to clause 3.<br />
The DEPUTY PRESIDENT — Order! Let us deal<br />
with it in clause 3. I will give Mr Somyurek the<br />
opportunity to re-ask the question then.<br />
Ms PENNICUIK (Southern Metropolitan) —<br />
Mr Somyurek asked a question about stakeholder<br />
consultation. The minister mentioned that he had<br />
written to all the councils. There are two parts to this<br />
question: what local government areas raised this as an<br />
issue with the minister prior to the election; and how<br />
many responses did the minister receive from local<br />
councils when he wrote to them?<br />
Mr P. DAVIS (Eastern <strong>Victoria</strong>) — I am delighted<br />
to have the opportunity to pre-empt the minister’s<br />
response in relation to Ms Pennicuik’s implied<br />
suggestion that this was not a significant issue. In her<br />
question she asked the minister, ‘Who raised this with<br />
you?’ If Ms Pennicuik had been able to get <strong>of</strong>f her<br />
bicycle, into a motor car and out <strong>of</strong> metropolitan<br />
Melbourne into the country she may have found that<br />
the country communities affected by the changes in<br />
2008 were in revolt — and they were, right around the<br />
state. All Ms Pennicuik has to do is go through the<br />
press clippings. If Ms Pennicuik had gone to the library
