<strong>Victoria</strong>n certificate <strong>of</strong> education: Premier’s<br />

awards<br />

Mrs PEULICH — On another matter, I<br />

congratulate all the recipients <strong>of</strong> the Premier’s <strong>Victoria</strong>n<br />

certificate <strong>of</strong> education awards, announced yesterday,<br />

and in particular I congratulate those from South<br />

Eastern Metropolitan Region. They have been able to<br />

achieve their outstanding success on the basis <strong>of</strong> their<br />

commitment, passion, talent and hard work as well as<br />

with the support <strong>of</strong> their principals, parents, families,<br />

friends, heroes and inspirational public figures. Some <strong>of</strong><br />

the recipients <strong>of</strong> the awards included: Brendan<br />

Clarnette, <strong>Victoria</strong> Collins, Ashley Davies, David<br />

Delmenico, Sade Dikmen, Michael Edwards, Robert<br />

Foyster, Natalie Gombos, Jessica Hellier, Rosa Hwang,<br />

Jia Qi Lee, Alexandra Longhouse, Jayden<br />

Lynch-Cooper, Andrew Saw, Liana Selimi, Dane<br />

Sherburn, Jake Spain, Sharon Tan, Ella Wardlaw,<br />

Andrew Wong, Li Jian Wong and Janahan<br />

Shanmugananthakumar. Congratulations to them all;<br />

they should be very proud.<br />

Royal Melbourne Yacht Squadron: breakwater<br />

Mrs COOTE (Southern Metropolitan) — Last<br />

Friday the Minister for Environment and Climate<br />

Change, Ryan Smith, announced that the Royal<br />

Melbourne Yacht Squadron had been granted approval<br />

to commence stage 1 <strong>of</strong> the reconstruction <strong>of</strong> its<br />

breakwater in St Kilda harbour. The new breakwater<br />

will be an extension <strong>of</strong> the existing structure and will<br />

improve safety for boating and other water-based<br />

activities in the St Kilda harbour precinct.<br />

Accompanied by another member for Southern<br />

Metropolitan Region, Georgie Crozier, Commodore<br />

Stuart Tait and yacht squadron members, we viewed<br />

the area and had a very good opportunity to see what<br />

this new development will be.<br />

Australian Women’s Keelboat Regatta<br />

Mrs COOTE — Whilst at the yacht squadron I met<br />

with Linda Goldsmith, who took the opportunity to tell<br />

me about the 21st Australian Women’s Keelboat<br />

Regatta, which will be held in June this year. It is the<br />

only annual sailing event in Australia held over three<br />

days for all-female crews. The regatta attracts women<br />

aged between 15 and 60 years <strong>of</strong> age, with over<br />

180 individual competitors each year. It is the most<br />

popular event for women who want to learn about and<br />

participate in keelboat racing in Australia. As well as<br />

encouraging the participation <strong>of</strong> women in the sport <strong>of</strong><br />

sailing, the regatta encourages the participation <strong>of</strong><br />

women in the management aspects <strong>of</strong> the event. It is<br />

one <strong>of</strong> the few regattas in Australia with a female<br />

principal race <strong>of</strong>ficer.<br />

All associated with the Royal Melbourne Yacht<br />

Squadron are to be congratulated.<br />

Debate resumed from 5 May; motion <strong>of</strong><br />

Hon. R. A. DALLA-RIVA (Minister for<br />

Employment and Industrial Relations).<br />

Hon. M. P. PAKULA (Western Metropolitan) — It<br />

gives me pleasure to rise to speak on this bill and to<br />

indicate that the opposition supports it. As the chamber<br />

knows, this bill is the culmination <strong>of</strong> efforts by<br />

government, by the <strong>Parliament</strong> and by the legal<br />

community more generally to ensure that the statute<br />

book <strong>of</strong> this state is able to deal with the kind <strong>of</strong><br />

disgraceful behaviour that occurred at Cafe Vamp in<br />

Hawthorn back in 2005–06 and that it is able to deal<br />

with all incidents and behaviour <strong>of</strong> a similar nature<br />

wherever they occur in the state <strong>of</strong> <strong>Victoria</strong>.<br />

I think all members <strong>of</strong> the house would recall with great<br />

sadness that at Cafe Vamp a 19-year-old woman,<br />

Brodie Panlock, was subjected to a campaign <strong>of</strong> abuse,<br />

workplace bullying and intimidation by three<br />

tormentors — Nicholas Smallwood, Rhys MacAlpine<br />

and Gabriel Toomey — who, amongst other disgraceful<br />

acts, spat on her, poured beer and oil on her and <strong>of</strong>fered<br />

her rat poison. We can only imagine what other<br />

degradation and disgraceful behaviour that poor woman<br />

was subjected to. As has been well publicised, in 2006<br />

at the age <strong>of</strong> 19, Brodie took her own life.<br />

It has also been well publicised that those three<br />

tormentors and the owner <strong>of</strong> the cafe, Marc Luis Da<br />

Cruz, were all charged under occupational health and<br />

safety laws. They were fined a total <strong>of</strong> $335 000 —<br />

$250 000 <strong>of</strong> which was applied to the owner <strong>of</strong> the cafe<br />

and $85 000 <strong>of</strong> which was applied to the perpetrators <strong>of</strong><br />

the behaviour — but none were charged under the<br />

Crimes Act 1958, and obviously as a consequence none<br />

<strong>of</strong> them received a custodial sentence. Understandably,<br />

Brodie’s family, particularly her parents, Damian and<br />

Rae, have bravely been campaigning for a change to the<br />

law since the WorkSafe prosecution occurred.
