Resolution Requesting the Governor and the<br />

Commissioner of Education to Accept Their Abilty to<br />

Reverse an Ilegal Vote That Circumvented the Public's<br />

Involvement When a Two-year Contract Extension for the<br />

Superintendent of the <strong>Jersey</strong> <strong>City</strong> Public School System<br />

Granted<br />

Whereas, the <strong>Jersey</strong> <strong>City</strong> Board of Education recently granted a two-year contract extension<br />

for the Superintendent of the <strong>Jersey</strong> <strong>City</strong> public school system; and<br />

Whereas, New <strong>Jersey</strong> State Law l8A:ll-11 mandates that:<br />

. "a board of education canot in any way take action on a superintendent's contract<br />

unless notice is provided to the public at least 30 days prior."<br />

. "the board (of education) must hold a public meeting and give 10 days notice of that<br />

meeting." ; and,<br />

Whereas, the <strong>Jersey</strong> <strong>City</strong> Board of Education did not follow the law to involve the public in<br />

the process prior to altering a leadership contract; and<br />

Whereas, the <strong>Jersey</strong> <strong>City</strong> public school system now has 35 out of 40 failing schools by state<br />

standards; and<br />

Whereas, it is vital that both the law is followed and the public is given an opportnity to<br />

express support or concerns; and<br />

Whereas, the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> has a unique opportunity to gauge public support and<br />

explore all options with regards to <strong>Jersey</strong> <strong>City</strong> school leadership.<br />

Now, Therefore, Be It Resolved, by the Municipal Council of the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> that<br />

we hereby request that the Governor and the Commissioner of Education accept their ability<br />

to reverse an ilegal vote that circumvented the public's involvement.<br />
