Trinity Mirror plc, and Richard Wallace, editor, Daily Mirror—Oral evidence (QQ 1233– 1305) Q120 The Lord Bishop of Chester: As the courts have considered matters of privacy over the past 10 years, do you feel that they have now got the balance about right between freedom of expression and privacy? Marcus Partington: I think the balance is still wrong, although recently it has been moving in a better direction with the judgment by Mr Justice Nicol in the Ferdinand case. It has been too easy for people to get through the article 8 gateway and too hard for people to get through the article 10 gateway in terms of balancing the two. I think a number of issues need to be looked at. I think there needs to be a greater scrutiny about whether the claims that are brought in certain cases are really libel cases dressed up as privacy cases, and I think there needs to be greater scrutiny of people’s attitudes to their own privacy. To what extent have they given up their privacy, and what is their own attitude to privacy? One of the problems is that the courts have not followed section 12(4) of the Human Rights Act 1998, which said that the court must have particular regard to freedom of expression. When clause 13, which became section 12, was debated in the House of Commons on 2 July 1998, Jack Straw, the Minister, was very keen to stress that steps were being taken to ensure freedom of expression, saying, “We have decided to introduce a new clause specifically designed to safeguard press freedom …We have taken the opportunity to enhance press freedom in a wider way than would arise simply from the incorporation of the Convention into our domestic law.” Unfortunately, since the case of Re S, which was a 2005 decision of the House of Lords, the House of the Lords and the courts have proceeded on the basis that both rights are equal, whereas Parliament was very concerned to ensure, when the Human Rights Act was passed, that the rights were not equal. As I say, the most recent judgment by Mr Justice Nicol in the Ferdinand case would seem to indicate, if that is followed by other judges in other courts, that there may be a rebalancing taking place. Q121 Lord Gold: Section 12 does require the claimant, as it were, to convince the court that he is likely to win. Isn’t that enough protection? Marcus Partington: Section 12(3) does indeed require that the court must be satisfied that the claimant is more likely to win than not. The courts have paid attention to what Parliament wanted by section 12(3), but I do not think the courts paid attention to what Parliament said in section 12(2) until the Neuberger committee’s report, and I do not think they have paid enough attention to section 12(4), so it is not enough just to say the claimant satisfies the test under section 12(3). Q122 The Lord Bishop of Chester: Given that there is some uncertainty about the balance that has evolved, and also uncertainty as to how the courts are applying the law, does that make it rather difficult in practice to know what the law on privacy is and what you can safely publish? Richard Wallace: You have the nub of the point there. I believe there is always going to be this tension, and we are not going to solve it in this room or in any other forum. The tension between those two articles is something that you have to consider all the time, certainly as an editor. Getting the balance right is critical, and as Marcus has pointed out, 1189
