will not offer PERS in its first year of operation, the school retains the option to choose<br />

to participate in PERS or another qualified plan depending upon employee eligibility<br />

and the determination of the best interest of the staff and the school as a whole by the<br />

Board of Directors. The <strong>ARISE</strong> Board will inform the OUSD Charter <strong>School</strong>'s Office in<br />

writing if it decides to participate in PERS or another qualified retirement plan. This<br />

change will not constitute a material revision of the charter.<br />

The Bookkeeper/business services provider will work with OUSD and/or the County<br />

Office of Education to ensure that appropriate arrangements for the allowable<br />

coverage have been made. All employees who are not members of STRS or PERS, or<br />

an alternative qualified retirement plan must contribute to the federal social security<br />

system to the extent required by federal law.<br />

<strong>ARISE</strong> <strong>High</strong> <strong>School</strong> will make the appropriate employee STRS withholding from the<br />

employees' paycheck and will contribute the employer's portion, and in the event that<br />

the school elects to allow its eligible employees to participate in PERS in the future,<br />

the school will do the same for classified employees. All withholdings from employees<br />

and the employer contribution from <strong>ARISE</strong> <strong>High</strong> <strong>School</strong> will be forwarded in a timely<br />

fashion to the county as required. At the Alameda County Office of Education's<br />

request, the school will pay the County a reasonable fee for the provision of such<br />

services.<br />

<strong>ARISE</strong> <strong>High</strong> <strong>School</strong> will also make contributions for workers' compensation insurance,<br />

unemployment insurance, and any other payroll obligations of an employer.<br />

EMPLOYEE REPRESENTATION<br />

<strong>ARISE</strong> <strong>High</strong> <strong>School</strong> shall be deemed the exclusive public school employer of the<br />

employees of <strong>ARISE</strong> <strong>High</strong> <strong>School</strong> for the purposes of the Education Employment<br />

Relations Act (EERA). <strong>ARISE</strong> Charter <strong>School</strong> will adhere to all applicable provisions<br />

of EERA.<br />

RIGHTS OF SCHOOL DISTRICT EMPLOYEES<br />

All employees join <strong>ARISE</strong> <strong>High</strong> <strong>School</strong> staff voluntarily. An employee joining <strong>ARISE</strong><br />

<strong>High</strong> <strong>School</strong> staff may do so as a result of taking leave from employment with the<br />

sponsoring district, Oakland Unified <strong>School</strong> District. <strong>ARISE</strong> <strong>High</strong> <strong>School</strong> employees<br />

who were previously employees of OUSD shall have only those benefits and rights<br />

afforded to any other employee in their collective bargaining unit or employment status<br />

who leave the district for employment with any private employer. At the time of this<br />

charter submission, there are no such return rights for any employees.<br />

HEALTH AND SAFETY<br />

<strong>ARISE</strong> <strong>High</strong> <strong>School</strong> shall comply with all applicable provisions of Education Code §<br />

44237, including the requirement that as a condition of employment each new<br />

employee must submit two sets of fingerprints to the California Department of Justice<br />
