Mr. NiTTLE. You <strong>in</strong>voke <strong>the</strong> provisions of <strong>the</strong> first amendment of<br />

<strong>the</strong> Constitution. Do you <strong>in</strong>voke <strong>the</strong> provisions of <strong>the</strong> fifth amendment<br />

of <strong>the</strong> Constitution?<br />

Mr. Darr. No, sir, I do not.<br />

Mr. NiTTLE. And do you <strong>in</strong>voke specifically<br />

Mr. Darr. Except <strong>for</strong> <strong>the</strong> due process. I was rem<strong>in</strong>ded of this<br />

once be<strong>for</strong>e.<br />

Mr. NiTTLE. You <strong>in</strong>voke <strong>the</strong> due process clause of <strong>the</strong> fifth amendment,<br />

but<br />

Mr. Darr, Not <strong>the</strong> self-<strong>in</strong>crim<strong>in</strong>ation part.<br />

Mr. NiTTLE. In view of that response by <strong>the</strong> witness, Mr. Chairman,<br />

I respectfully request that he be directed to answer <strong>the</strong> question.<br />

Mr. Doyle. I direct you to answer <strong>the</strong> question.<br />

Mr. Darr. May I now say why I won't answer?<br />

Mr. NiTTLE. Just a moment. I th<strong>in</strong>k you stated your grounds,<br />

Mr. Darr, and, if <strong>in</strong> response to future questions you wish to rely<br />

upon those grounds, I th<strong>in</strong>k it will be sufficient <strong>for</strong> you to state, "I<br />

refuse to respond <strong>for</strong> <strong>the</strong> same reasons."<br />

Mr. Darr. Then let me just, if I may, add one phrase, that I<br />

stand on <strong>the</strong> first amendment to that degree because <strong>the</strong> first amendment<br />

protects <strong>the</strong><br />

Mr. NiTTLE. We don't require any explanation of <strong>the</strong> first amendment.<br />

We have had o<strong>the</strong>r witnesses rely upon that as well, and I<br />

th<strong>in</strong>k <strong>the</strong> Congress fully understands <strong>the</strong> Constitution.<br />

Mr. Darr. Mr. Chairman, could I read this one sentence?<br />

Mr. Doyle. No. The committee will accept <strong>the</strong> way our counsel<br />

has suggested as to your statement, that you refuse to answer that<br />

question on <strong>the</strong> ground previously stated.<br />

Mr. Darr. So what you are say<strong>in</strong>g is you are refus<strong>in</strong>g to let me state<br />

my ground <strong>in</strong> full or even <strong>in</strong> a one-sentence statement.<br />

Mr. Doyle. You have stated your ground.<br />

Mr. Darr. But I haven't, sir. Really, <strong>the</strong>re are very profound<br />

reasons why I, <strong>in</strong> good conscience, refuse to cooperate with this<br />

committee.<br />

Mr. Doyle. Then <strong>in</strong> good conscience cooperate with <strong>the</strong> extent of<br />

our suggestion, <strong>in</strong> order to save time and all, that you refuse to answer<br />

on <strong>the</strong> grounds previously stated.<br />

Mr. Darr. Ord<strong>in</strong>arily I would like to answer <strong>the</strong>se questions,<br />

but I won't<br />

Mr. Doyle. I am not go<strong>in</strong>g to permit you to read that long statement.<br />

Mr. Darr. I understand that, sir. I am not <strong>in</strong>tend<strong>in</strong>g.<br />

Mr. Doyle. Please cooperate <strong>in</strong> good conscience, which you rely<br />

upon, and obey <strong>the</strong> rules of <strong>the</strong> committee.<br />

Mr. Darr. All right, sir.<br />

Mr. Doyle. That is a fair request. You know that.<br />

Mr. Darr. I want to cooperate with <strong>the</strong> rules, but not with <strong>the</strong><br />

procedure.<br />

Mr, NiTTLE. What is your present occupation?<br />

Mr. Darr. I refuse to answer, although I would be glad to answer<br />

under o<strong>the</strong>r circumstances because of my conscience.
