of Appeal <strong>in</strong> Attorney-General of Botswana v Dow Unity v Dow, 314 ‘sex’ is among<br />

<strong>the</strong> grounds protected aga<strong>in</strong>st discrim<strong>in</strong>ation by section 15 of <strong>the</strong> Constitution<br />

notwithst<strong>and</strong><strong>in</strong>g that it is not explicitly mentioned. On appeal, <strong>the</strong> Court of<br />

Appeal held that <strong>the</strong> provisions of <strong>the</strong> Penal Code <strong>in</strong> question were not<br />

<strong>in</strong>consistent with <strong>the</strong> Constitution. 315 <strong>The</strong> reason<strong>in</strong>g of <strong>the</strong> Court was essentially<br />

to endorse what <strong>the</strong> legislature had enacted <strong>and</strong> to treat legislation as express<strong>in</strong>g<br />

democratic will. <strong>The</strong> Court said that that by legislat<strong>in</strong>g aga<strong>in</strong>st ‘carnal knowledge<br />

of any person aga<strong>in</strong>st <strong>the</strong> order of nature‘ <strong>the</strong> legislature was clearly signal<strong>in</strong>g<br />

that it was aga<strong>in</strong>st liberalization of <strong>the</strong> crim<strong>in</strong>alization of same-sex. Accord<strong>in</strong>g to<br />

<strong>the</strong> Court, public sentiment was aga<strong>in</strong>st such liberalization <strong>and</strong> <strong>the</strong>re was no<br />

evidence to show that public op<strong>in</strong>ion had relented. <strong>The</strong> Court of Appeal<br />

purported to repair <strong>the</strong> anomaly by extend<strong>in</strong>g <strong>the</strong> offence to cover also acts<br />

between men <strong>and</strong> women. 316 Ironically, <strong>the</strong> Court of Appeal of Botswana<br />

justified extend<strong>in</strong>g <strong>the</strong> common law crime of sodomy to cover acts between men<br />

<strong>and</strong> women, <strong>in</strong>ter alia, on <strong>the</strong> ground of check<strong>in</strong>g <strong>the</strong> spread of HIV.<br />

[76] Prior to its amendment, article 31(1) of <strong>the</strong> Constitution of Ug<strong>and</strong>a provided that<br />

that ‘men <strong>and</strong> women of <strong>the</strong> age of eighteen years <strong>and</strong> above have <strong>the</strong> right to<br />

marry <strong>and</strong> to found a family …. ’ In 2005, article 31 was amended to <strong>the</strong> effect<br />

that ‘marriage between persons of <strong>the</strong> same sex is prohibited ’. <strong>The</strong> effect of <strong>the</strong><br />

amendment is to expressly prohibit same-sex marriages. Ug<strong>and</strong>a is <strong>the</strong> first<br />

African country to embark on this course which is a product of political<br />

antipathy towards gay <strong>and</strong> lesbian persons <strong>in</strong> Ug<strong>and</strong>a. 317 <strong>The</strong> amendment clearly<br />

marks <strong>the</strong> Ug<strong>and</strong>an government as opposed reforms to recognise <strong>sexual</strong><br />

diversity, <strong>in</strong>clud<strong>in</strong>g homo<strong>sexual</strong>ity <strong>and</strong> lesbianism. 318 Same-sex <strong>sexual</strong> activity is<br />

punishable as an ‘unnatural offence’ under section 145 of <strong>the</strong> Ug<strong>and</strong>an Penal<br />

Code Act <strong>and</strong> carries a maximum penalty of life imprisonment upon conviction.<br />

[77] South Africa has blazed <strong>the</strong> global trail by be<strong>in</strong>g <strong>the</strong> first country to provide for<br />

protection aga<strong>in</strong>st discrim<strong>in</strong>ation on <strong>the</strong> ground of ‘<strong>sexual</strong> orientation’ <strong>in</strong> its<br />

Constitution. 319 <strong>The</strong> South African Employment Equity Act 320 <strong>and</strong> <strong>the</strong> Equality<br />

Act 321 follow suit by list<strong>in</strong>g ‘<strong>sexual</strong> orientation’ as a ground protected aga<strong>in</strong>st<br />

unfair discrim<strong>in</strong>ation. Over <strong>and</strong> above explicit protection <strong>in</strong> <strong>the</strong> Constitution <strong>and</strong><br />

<strong>in</strong> legislative <strong>in</strong>struments, <strong>the</strong> Constitutional Court has affirmed that <strong>sexual</strong><br />
