(5) Noth<strong>in</strong>g shall be taken to be <strong>in</strong>consistent with this article which is allowed to<br />

be done under any provision of this Constitution.<br />

to lawful <strong>rights</strong> are those necessary to ensure peaceful <strong>human</strong> <strong>in</strong>teraction <strong>in</strong> an<br />

open <strong>and</strong> democratic society.<br />

Article 13<br />

Pr<strong>in</strong>ciples of national policy<br />

<strong>The</strong> State shall actively promote <strong>the</strong> welfare <strong>and</strong> development of <strong>the</strong> people of<br />

Malawi by progressively adopt<strong>in</strong>g <strong>and</strong> implement<strong>in</strong>g policies <strong>and</strong> legislation<br />

aimed at achiev<strong>in</strong>g <strong>the</strong> follow<strong>in</strong>g goals--<br />

(a) Gender Equality<br />

To obta<strong>in</strong> gender equality for women with men through--<br />

(i) full participation of women <strong>in</strong> all spheres of Malawian society on <strong>the</strong> basis of<br />

equality with men;<br />

(ii) <strong>the</strong> implementation of <strong>the</strong> pr<strong>in</strong>ciples of non-discrim<strong>in</strong>ation <strong>and</strong> such o<strong>the</strong>r<br />

measures as may be required; <strong>and</strong><br />

(iii) <strong>the</strong> implementation of policies to address social issues such as domestic<br />

violence, security of <strong>the</strong> person, lack of maternity benefits, economic exploitation<br />

<strong>and</strong> <strong>rights</strong> to property<br />

Article 20<br />

(1) Discrim<strong>in</strong>ation of persons <strong>in</strong> any form is prohibited <strong>and</strong> all persons are, under any<br />

law, guaranteed equal <strong>and</strong> effective protection aga<strong>in</strong>st discrim<strong>in</strong>ation on grounds of race,<br />

colour, sex, language, religion, political or o<strong>the</strong>r op<strong>in</strong>ion, nationality, ethnic or social<br />

orig<strong>in</strong>, disability, property, birth or o<strong>the</strong>r status.<br />

(2) Legislation may be passed address<strong>in</strong>g <strong>in</strong>equalities <strong>in</strong> society <strong>and</strong> prohibit<strong>in</strong>g<br />

discrim<strong>in</strong>atory practices <strong>and</strong> <strong>the</strong> propagation of such practices <strong>and</strong> may render such<br />

practices crim<strong>in</strong>ally punishable by <strong>the</strong> courts.<br />

Article 24<br />

(1) Women have <strong>the</strong> right to full <strong>and</strong> equal protection by <strong>the</strong> law, <strong>and</strong> have <strong>the</strong><br />

right not to be discrim<strong>in</strong>ated aga<strong>in</strong>st on <strong>the</strong> basis of <strong>the</strong>ir gender or marital status<br />

which <strong>in</strong>cludes <strong>the</strong> right-<br />

(a) to be accorded <strong>the</strong> same <strong>rights</strong> as men <strong>in</strong> civil law, <strong>in</strong>clud<strong>in</strong>g equal capacity-<br />

(i) to enter <strong>in</strong>to contracts;<br />

(ii) to acquire <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong> <strong>rights</strong> <strong>in</strong> property, <strong>in</strong>dependently or <strong>in</strong><br />

association with o<strong>the</strong>rs, regardless of <strong>the</strong>ir marital status;<br />

(iii) to acquire <strong>and</strong> reta<strong>in</strong> custody, guardianship <strong>and</strong> care of children <strong>and</strong><br />

to have an equal right <strong>in</strong> <strong>the</strong> mak<strong>in</strong>g of decisions that affect <strong>the</strong>ir<br />

upbr<strong>in</strong>g<strong>in</strong>g; <strong>and</strong><br />

(iv) to acquire <strong>and</strong> reta<strong>in</strong> citizenship <strong>and</strong> nationality.<br />
