<strong>and</strong> coord<strong>in</strong>at<strong>in</strong>g with o<strong>the</strong>r domestic <strong>and</strong> foreign agencies; <strong>and</strong> rehabilitation of<br />

trafficked persons. In 2009, <strong>the</strong> Agency reported that it had <strong>in</strong>vestigated 209<br />

traffick<strong>in</strong>g offences, prosecuted 37 cases, <strong>and</strong> achieved convictions <strong>in</strong> 19 cases for<br />

<strong>sexual</strong> exploitation <strong>and</strong> four for economic exploitation. 640 <strong>The</strong> prison sentences<br />

imposed ranged from 6 months to 40 years. In 2008, <strong>the</strong> Agency identified 887<br />

victims/survivors of traffick<strong>in</strong>g result<strong>in</strong>g <strong>in</strong> <strong>the</strong> majority of <strong>the</strong><br />

victims/survivors be<strong>in</strong>g rescued by <strong>the</strong> follow<strong>in</strong>g entities: National Agency;<br />

Immigration Service; National Police; Civil Defence Corps; Federal Road Safety;<br />

State Security Service; <strong>and</strong> Nigerian Embassy. 641 <strong>The</strong> Agency has been active <strong>in</strong><br />

provid<strong>in</strong>g shelter <strong>and</strong> counsel<strong>in</strong>g to victims/survivors. It has also convened<br />

forums to raise public awareness about traffick<strong>in</strong>g. 642<br />

[66] Though Kenya does not have a statute that is dedicated to traffick<strong>in</strong>g, its Sexual<br />

Offences Act of 2003 has provisions that are traffick<strong>in</strong>g-specific. Section 13 of <strong>the</strong><br />

Sexual Offence Act crim<strong>in</strong>alizes domestic as well as cross-border traffick<strong>in</strong>g of<br />

children for <strong>sexual</strong> exploitation. Section 13(a) crim<strong>in</strong>alizes mak<strong>in</strong>g or organiz<strong>in</strong>g<br />

travel arrangements <strong>in</strong> relation to <strong>the</strong> <strong>sexual</strong> exploitation of a child <strong>in</strong> Kenya or<br />

outside <strong>the</strong> country’s borders. Section 13(b) crim<strong>in</strong>alizes supply<strong>in</strong>g, recruit<strong>in</strong>g,<br />

transferr<strong>in</strong>g, harbour<strong>in</strong>g, or receiv<strong>in</strong>g a child for <strong>sexual</strong> exploitation. Article 14<br />

makes it an offence to make arrangements that facilitate o<strong>the</strong>rs to travel with <strong>the</strong><br />

<strong>in</strong>tention to commit <strong>sexual</strong> offences aga<strong>in</strong>st children. Section 15 crim<strong>in</strong>alizes<br />

facilitat<strong>in</strong>g <strong>sexual</strong> exploitation of children through activities such as facilitat<strong>in</strong>g<br />

sex work, keep<strong>in</strong>g a bro<strong>the</strong>l where children are <strong>sexual</strong>ly exploited <strong>and</strong> us<strong>in</strong>g<br />

children <strong>in</strong> <strong>sexual</strong>ly exploitative exhibitions.<br />

[67] Article 18 of <strong>the</strong> Ethiopian Constitution, which guarantees a right to protection<br />

aga<strong>in</strong>st cruel, <strong>in</strong><strong>human</strong> or degrad<strong>in</strong>g treatment or punishment, <strong>in</strong>cludes a<br />

provision which says ‘Traffick<strong>in</strong>g <strong>in</strong> <strong>human</strong> be<strong>in</strong>gs for whatever purposes is<br />

prohibited’. <strong>The</strong> Ethiopian Constitution is <strong>the</strong> only example of a constitution that<br />

makes a specific guarantee aga<strong>in</strong>st <strong>human</strong> traffick<strong>in</strong>g. O<strong>the</strong>rwise, traffick<strong>in</strong>g for<br />

<strong>sexual</strong> exploitation is governed by <strong>the</strong> provisions of <strong>the</strong> Ethiopian Crim<strong>in</strong>al<br />

Code. Article 596 explicitly forbids <strong>human</strong> ‘traffick<strong>in</strong>g’ whatever reason. Article<br />

597 specifically prohibits traffick<strong>in</strong>g <strong>in</strong> ‘women <strong>and</strong> children’ generally while<br />

article 635 prohibits <strong>the</strong> traffick<strong>in</strong>g of’ women <strong>and</strong> m<strong>in</strong>ors’ for <strong>sexual</strong><br />

exploitation. Article 634 of <strong>the</strong> Crim<strong>in</strong>al Code, which crim<strong>in</strong>alizes mak<strong>in</strong>g a<br />

liv<strong>in</strong>g out of <strong>sexual</strong> exploitation of o<strong>the</strong>rs, is applicable to traffick<strong>in</strong>g for <strong>sexual</strong><br />

exploitation.<br />
