care services, employment, or education. In such contexts, <strong>the</strong> <strong>human</strong> <strong>rights</strong> to<br />
heath, work, education <strong>and</strong> <strong>in</strong>formation are also adversely impacted upon.<br />
[13] As alluded to <strong>in</strong> Chapter 2 of this study, only one African country – South Africa<br />
– has taken steps to reform <strong>the</strong> law so as to decrim<strong>in</strong>alize sex between males.<br />
South Africa decrim<strong>in</strong>alized same-sex <strong>sexual</strong> activities <strong>in</strong> National Coalition for<br />
Gay <strong>and</strong> Lesbian Equality <strong>and</strong> O<strong>the</strong>rs v M<strong>in</strong>ister of Justice <strong>and</strong> O<strong>the</strong>rs 384 through a<br />
judicial rul<strong>in</strong>g render<strong>in</strong>g common law <strong>and</strong> statutory same-sex offences<br />
unconstitutional. 385<br />
3.3 Penalization of Ages of Consent for Sexual Activities<br />
[14] <strong>The</strong> age of consent for <strong>sexual</strong> activities, <strong>and</strong> <strong>in</strong> particular <strong>sexual</strong> <strong>in</strong>tercourse, is<br />
<strong>the</strong> subject of regulation by every African country. <strong>The</strong> state has a legitimate<br />
<strong>in</strong>terest <strong>in</strong> regulat<strong>in</strong>g <strong>the</strong> age of consent for <strong>sexual</strong> activities to protect young<br />
persons from <strong>sexual</strong> exploitation, abuse <strong>and</strong> <strong>sexual</strong> violence not least rape. Rape<br />
is clearly crim<strong>in</strong>alized for <strong>the</strong> purposes of protect<strong>in</strong>g <strong>the</strong> physical <strong>and</strong><br />
psychological <strong>in</strong>tegrity of an unwanted <strong>in</strong>trusion <strong>and</strong> is outside <strong>the</strong> scope of this<br />
section. <strong>The</strong> focus <strong>in</strong> this section is on <strong>sexual</strong> activities fall<strong>in</strong>g outside of<br />
conventional rape.<br />
[15] African laws, like <strong>the</strong>ir counterparts, <strong>in</strong> o<strong>the</strong>r <strong>region</strong>s regulate <strong>sexual</strong> activities<br />
by, <strong>in</strong>ter alia, prescrib<strong>in</strong>g <strong>the</strong> age of consent for <strong>sexual</strong> activities that do not<br />
necessarily <strong>in</strong>volve violence for protective reasons. Engag<strong>in</strong>g <strong>in</strong> <strong>sexual</strong> activities<br />
has physical <strong>and</strong> psychological <strong>health</strong> implications some of which are positive<br />
<strong>and</strong> some of which are negative. On <strong>the</strong> positive side is that <strong>sexual</strong> activities are<br />
part of how <strong>human</strong> be<strong>in</strong>gs express <strong>the</strong>ir personhood, realize <strong>the</strong>ir <strong>sexual</strong><br />
identities <strong>and</strong> self-determ<strong>in</strong>ation generally. On <strong>the</strong> negative side, <strong>sexual</strong> activities<br />
are clearly harmful to persons that have not reached a stage of physical <strong>and</strong><br />
psychological maturity that allows <strong>the</strong>m not only to underst<strong>and</strong> what is <strong>in</strong>volved<br />
<strong>in</strong> <strong>sexual</strong> activities, but also <strong>the</strong> implications <strong>the</strong>reof so as to be <strong>in</strong> a position to<br />
decide whe<strong>the</strong>r to engage <strong>in</strong> <strong>sexual</strong> activities.<br />
[16] <strong>The</strong> state has a legitimate <strong>in</strong>terest <strong>in</strong> prescrib<strong>in</strong>g differential ages for engag<strong>in</strong>g <strong>in</strong><br />
<strong>sexual</strong> <strong>in</strong>tercourse <strong>in</strong> order to protect <strong>the</strong> best <strong>in</strong>terests of those that are not <strong>in</strong> a<br />
position to underst<strong>and</strong> what is <strong>in</strong>volved <strong>in</strong> <strong>sexual</strong> <strong>in</strong>tercourse or to deal with <strong>the</strong><br />
risks <strong>in</strong>herent <strong>in</strong> <strong>sexual</strong> <strong>in</strong>tercourse, <strong>in</strong>clud<strong>in</strong>g <strong>sexual</strong>ly transmitted <strong>in</strong>fections<br />
<strong>and</strong> pregnancy. At <strong>the</strong> same time, <strong>the</strong> state must concede that ultimately, when<br />
