equires <strong>the</strong> decision to repatriate a trafficked child to take <strong>in</strong>to account <strong>the</strong><br />

possibility of fur<strong>the</strong>r harm follow<strong>in</strong>g repatriation 636<br />

requires due assistance to be rendered to trafficked child who is to be repatriated,<br />

<strong>in</strong>clud<strong>in</strong>g f<strong>in</strong>ancial assistance 637<br />

provides for <strong>the</strong> recognition as domestic crime, a traffick<strong>in</strong>g crime committed<br />

outside South Africa by a citizen or permanent resident of South Africa. 638<br />

[62] <strong>The</strong> South African Sexual Offences Act of 2007 addresses traffick<strong>in</strong>g, but only <strong>in</strong><br />

relation to traffick<strong>in</strong>g for <strong>sexual</strong> exploitation. Section 70(1) of <strong>the</strong> Sexual Offences<br />

Act says that <strong>the</strong> provisions of <strong>the</strong> Act relat<strong>in</strong>g to traffick<strong>in</strong>g are transitional<br />

pend<strong>in</strong>g adoption of legislation <strong>in</strong> compliance with Palermo Protocol. <strong>The</strong> Act<br />

crim<strong>in</strong>alizes traffick<strong>in</strong>g for <strong>sexual</strong> exploitation us<strong>in</strong>g st<strong>and</strong>ards that are adopted<br />

from <strong>the</strong> Palermo Protocol. A bill on <strong>human</strong> traffick<strong>in</strong>g <strong>and</strong> not just traffick<strong>in</strong>g<br />

for <strong>sexual</strong> exploitation is currently before Parliament.<br />

[63] <strong>The</strong> Nigerian Traffick<strong>in</strong>g <strong>in</strong> Persons (Prohibition) Law Enforcement <strong>and</strong><br />

Adm<strong>in</strong>istration Act of 2005 prohibits <strong>human</strong> traffic for exploitation. Section 50 of<br />

<strong>the</strong> Nigerian Traffick<strong>in</strong>g <strong>in</strong> Persons Act, which derives from article 3 of <strong>the</strong><br />

Palermo Protocol, def<strong>in</strong>es traffick<strong>in</strong>g as <strong>in</strong>clud<strong>in</strong>g:<br />

…all acts <strong>and</strong> attempted acts <strong>in</strong>volved <strong>in</strong> <strong>the</strong> recruitment, transportation with<strong>in</strong> or<br />

across Nigerian borders, purchase, sale, transfer, receipt or harbour<strong>in</strong>g of a person<br />

<strong>in</strong>volv<strong>in</strong>g <strong>the</strong> use of deception, coercion or debt bondage for <strong>the</strong> purpose of plac<strong>in</strong>g<br />

or hold<strong>in</strong>g <strong>the</strong> person whe<strong>the</strong>r for or not <strong>in</strong> <strong>in</strong>voluntary servitude (domestic, <strong>sexual</strong><br />

or reproductive) <strong>in</strong> force or bonded labour, or <strong>in</strong> slavery-like conditions.<br />

[64] <strong>The</strong> def<strong>in</strong>ition of traffick<strong>in</strong>g under <strong>the</strong> Nigerian Traffick<strong>in</strong>g <strong>in</strong> Persons Act is<br />

<strong>in</strong>tended to capture <strong>the</strong> particular types of <strong>in</strong>tranational as well as <strong>in</strong>ternational<br />

traffick<strong>in</strong>g that take place <strong>in</strong> Nigeria. Nigeria is a major source, transit <strong>and</strong><br />

dest<strong>in</strong>ation for trafficked persons, with women <strong>and</strong> children as <strong>the</strong> most<br />

trafficked persons. 639 While <strong>sexual</strong> exploitation is <strong>the</strong> ma<strong>in</strong> reason for<br />

<strong>in</strong>ternational traffick<strong>in</strong>g, a holistic response to traffick<strong>in</strong>g must also seek to<br />

combat traffick<strong>in</strong>g for economic exploitation with<strong>in</strong> <strong>the</strong> country’s borders,<br />

especially <strong>in</strong> <strong>the</strong> domestic, farm, m<strong>in</strong><strong>in</strong>g <strong>and</strong> illegal drugs sectors as <strong>sexual</strong><br />

exploitation <strong>and</strong> economic exploitation often co-exist.<br />

[65] <strong>The</strong> Nigerian Act establishes a National Agency for Prohibition of Traffic <strong>in</strong><br />

Persons. This Agency is charged with various functions that are <strong>in</strong>tended to<br />

implement <strong>and</strong> render <strong>the</strong> Act effective, <strong>in</strong>clud<strong>in</strong>g: enforc<strong>in</strong>g <strong>and</strong> adm<strong>in</strong>ister<strong>in</strong>g<br />

<strong>the</strong> Act, through <strong>in</strong>ter alia, <strong>in</strong>vestigat<strong>in</strong>g <strong>and</strong> prosecut<strong>in</strong>g offenders; co-operat<strong>in</strong>g<br />
