psychological abuse; economic abuse; <strong>in</strong>timidation; harassment; stalk<strong>in</strong>g;<br />

damage to property; entry <strong>in</strong>to <strong>the</strong> compla<strong>in</strong>ant’s residence without consent,<br />

where <strong>the</strong> parties do not share <strong>the</strong> same residence; or any o<strong>the</strong>r controll<strong>in</strong>g or<br />

abusive behaviour towards a compla<strong>in</strong>ant, where such conduct harms, or may<br />

cause imm<strong>in</strong>ent harm to, <strong>the</strong> safety, <strong>health</strong> or wellbe<strong>in</strong>g of <strong>the</strong> compla<strong>in</strong>ant. 648<br />

[71] <strong>The</strong> parties aga<strong>in</strong>st whom a compla<strong>in</strong>ant is protected are widely def<strong>in</strong>ed under<br />

South African law. <strong>The</strong> compla<strong>in</strong>ant is protected from domestic violence that is<br />

perpetrated by a person with whom <strong>the</strong>y are <strong>in</strong> a ‘domestic relationship’.<br />

Accord<strong>in</strong>g to <strong>the</strong> Domestic Violence Act, a domestic relationship means a<br />

relationship between a compla<strong>in</strong>ant <strong>and</strong> a respondent <strong>in</strong> any of <strong>the</strong> follow<strong>in</strong>g<br />

ways:<br />

• <strong>the</strong>y are or were married to each o<strong>the</strong>r, <strong>in</strong>clud<strong>in</strong>g marriage accord<strong>in</strong>g to any law, custom<br />

or religion;<br />

• <strong>the</strong>y (whe<strong>the</strong>r <strong>the</strong>y are of <strong>the</strong> same or of <strong>the</strong> opposite sex) live or lived toge<strong>the</strong>r <strong>in</strong> a<br />

relationship <strong>in</strong> <strong>the</strong> nature of marriage, although <strong>the</strong>y are not, or were not, married to<br />

each o<strong>the</strong>r, or are not able to be married to each o<strong>the</strong>r;<br />

• <strong>the</strong>y are <strong>the</strong> parents of a child or are persons who have or had parental responsibility for<br />

that child (whe<strong>the</strong>r or not at <strong>the</strong> same time);<br />

• <strong>the</strong>y are family members related by consangu<strong>in</strong>ity, aff<strong>in</strong>ity or adoption;<br />

• <strong>the</strong>y are or were <strong>in</strong> an engagement, dat<strong>in</strong>g or customary relationship, <strong>in</strong>clud<strong>in</strong>g an actual<br />

or perceived romantic, <strong>in</strong>timate or <strong>sexual</strong> relationship of any duration; or<br />

• <strong>the</strong>y share or recently !shared <strong>the</strong> same residence. 649<br />

[72] Protection under <strong>the</strong> South African Domestic Violence Act can take a number of<br />

routes. A police officer, who is at <strong>the</strong> scene of an <strong>in</strong>cident of domestic violence,<br />

must render such assistance as may be required by <strong>the</strong> circumstances, <strong>in</strong>clud<strong>in</strong>g<br />

assist<strong>in</strong>g or mak<strong>in</strong>g arrangements for suitable shelter <strong>and</strong> obta<strong>in</strong><strong>in</strong>g medical<br />

attention, <strong>and</strong> lodg<strong>in</strong>g a crim<strong>in</strong>al compla<strong>in</strong>t. 650 A police officer may arrest<br />

without warrant a respondent he or she reasonably suspects of hav<strong>in</strong>g<br />

committed an offence conta<strong>in</strong><strong>in</strong>g an element of violence aga<strong>in</strong>st <strong>the</strong><br />

compla<strong>in</strong>ant. 651<br />

[73] Protection orders are <strong>the</strong> centerpiece of <strong>the</strong> Domestic Violence Act. <strong>The</strong><br />

compla<strong>in</strong>ant may apply to <strong>the</strong> court for a protection order. 652 <strong>The</strong> application<br />

may be lodged on <strong>the</strong> compla<strong>in</strong>ant’s behalf by any o<strong>the</strong>r person, <strong>in</strong>clud<strong>in</strong>g a<br />

police officer, counsellor, <strong>health</strong> service provider, social worker or teacher. 653<br />

<strong>The</strong> application can be brought outside of <strong>the</strong> ord<strong>in</strong>ary court hours if it is<br />
