[68] It is not just <strong>in</strong> constitutional adjudication but also at a legislative level that South<br />

Africa has taken a lead is explicitly provid<strong>in</strong>g HIV status as a ground protected<br />

aga<strong>in</strong>st non-discrim<strong>in</strong>ation. Section 6(1) of <strong>the</strong> South African Employment Equity<br />

Act prohibits unfair discrim<strong>in</strong>ation on <strong>the</strong> ground, <strong>in</strong>ter alia, of ‘HIV status’.<br />

Though <strong>the</strong> South African Promotion of Equality <strong>and</strong> Prevention of Unfair<br />

Discrim<strong>in</strong>ation Act (Equality Act) does not list HIV status as a protected ground,<br />

is it clear that such status falls under <strong>the</strong> category of an analogous ground under<br />

<strong>the</strong> Act. 273 Like <strong>the</strong> Constitution, protected grounds under <strong>the</strong> Equality Act are<br />

an open ra<strong>the</strong>r than closed category. Grounds that are analogous to listed<br />

grounds are protected. An analogous ground under <strong>the</strong> Equality Act is any o<strong>the</strong>r<br />

ground where discrim<strong>in</strong>ation based on that o<strong>the</strong>r ground satisfied any of <strong>the</strong><br />

follow<strong>in</strong>g elements — 1) causes or perpetuates systemic disadvantage; or 2)<br />

underm<strong>in</strong>es <strong>human</strong> dignity; or 3) adversely affects <strong>the</strong> equal enjoyment of a<br />

person’s <strong>rights</strong> <strong>and</strong> freedoms <strong>in</strong> a serious manner that is comparable to<br />

discrim<strong>in</strong>ation on a listed ground. 274 <strong>The</strong>se elements are derived from <strong>the</strong> test<br />

developed by <strong>the</strong> Constitutional Court <strong>in</strong> cases such as Harksen v Lane. 275 HIV<br />

status, which is <strong>the</strong> object of <strong>in</strong>tense societal discrim<strong>in</strong>ation, readily satisfies any<br />

of <strong>the</strong>se elements.<br />

[69] Outside of South Africa, only three of <strong>the</strong> surveyed African countries – Kenya<br />

Tanzania <strong>and</strong> Zimbabwe - have legislation that offers protection aga<strong>in</strong>st<br />

discrim<strong>in</strong>ation on <strong>the</strong> ground of HIV status. <strong>The</strong> Kenyan HIV/AIDS Prevention<br />

<strong>and</strong> Control Act of 2006 seeks, <strong>in</strong>ter alia, to ‘outlaw discrim<strong>in</strong>ation <strong>in</strong> all its forms<br />

<strong>and</strong> subtleties aga<strong>in</strong>st persons with or persons perceived or suspected of hav<strong>in</strong>g<br />

HIV <strong>and</strong> AIDS’. 276 In pursuit of this objective, <strong>the</strong> Kenyan Act prohibits<br />

discrim<strong>in</strong>atory acts <strong>and</strong> policies on <strong>the</strong> basis of HIV status <strong>in</strong> <strong>the</strong> follow<strong>in</strong>g areas:<br />

employment, 277 schools, 278 travel <strong>and</strong> habitation, 279 public office, 280 access to<br />

credit <strong>and</strong> <strong>in</strong>surance, 281 <strong>health</strong> sector, 282 <strong>and</strong> <strong>in</strong> burial services. 283 Discrim<strong>in</strong>ation<br />

<strong>in</strong> <strong>the</strong>se sectors constitutes a crim<strong>in</strong>al offence for which a perpetrator can be<br />
