2. Women have equal <strong>rights</strong> with men <strong>in</strong> marriage as prescribed by this<br />
Constitution.<br />
3. <strong>The</strong> historical legacy of <strong>in</strong>equality <strong>and</strong> discrim<strong>in</strong>ation suffered by women <strong>in</strong><br />
Ethiopia taken <strong>in</strong>to account, women, <strong>in</strong> order to remedy this legacy, are entitled<br />
to affirmative measures. <strong>The</strong> purpose of such measures shall be to provide<br />
special attention to women so as to enable <strong>the</strong>m to compete <strong>and</strong> participate on<br />
<strong>the</strong> basis of equality with men <strong>in</strong> political, social <strong>and</strong> economic life as well as <strong>in</strong><br />
public <strong>and</strong> private <strong>in</strong>stitutions.<br />
4. <strong>The</strong> State shall enforce <strong>the</strong> right of women to elim<strong>in</strong>ate <strong>the</strong> <strong>in</strong>fluences of<br />
harmful customs. Laws, customs <strong>and</strong> practices that oppress or cause bodily or<br />
mental harm to women are prohibited.<br />
5. (a) Women have <strong>the</strong> right to maternity leave with full pay. <strong>The</strong> duration of<br />
maternity leave shall be determ<strong>in</strong>ed by law tak<strong>in</strong>g <strong>in</strong>to account <strong>the</strong> nature of <strong>the</strong><br />
work, <strong>the</strong> <strong>health</strong> of <strong>the</strong> mo<strong>the</strong>r <strong>and</strong> <strong>the</strong> well-be<strong>in</strong>g of <strong>the</strong> child <strong>and</strong> family.<br />
(b) Maternity leave may, <strong>in</strong> accordance with <strong>the</strong> provisions of law, <strong>in</strong>clude<br />
prenatal leave with full pay.<br />
6. Women have <strong>the</strong> right to full consultation <strong>in</strong> <strong>the</strong> formulation of national<br />
development policies, <strong>the</strong> design<strong>in</strong>g <strong>and</strong> execution of projects, <strong>and</strong> particularly<br />
<strong>in</strong> <strong>the</strong> case of projects affect<strong>in</strong>g <strong>the</strong> <strong>in</strong>terests of women.<br />
7. Women have <strong>the</strong> right to acquire, adm<strong>in</strong>ister, control, use <strong>and</strong> transfer<br />
property. In particular, <strong>the</strong>y have equal <strong>rights</strong> with men with respect to use,<br />
transfer, adm<strong>in</strong>istration <strong>and</strong> control of l<strong>and</strong>. <strong>The</strong>y shall also enjoy equal<br />
treatment <strong>in</strong> <strong>the</strong> <strong>in</strong>heritance of property.<br />
8. Women shall have a right to equality <strong>in</strong> employment, promotion, pay, <strong>and</strong> <strong>the</strong><br />
transfer of pension entitlements.<br />
9. To prevent harm aris<strong>in</strong>g from pregnancy <strong>and</strong> childbirth <strong>and</strong> <strong>in</strong> order to<br />
safeguard <strong>the</strong>ir <strong>health</strong>, women have <strong>the</strong> right of access to family plann<strong>in</strong>g<br />
education, <strong>in</strong>formation <strong>and</strong> capacity.<br />

Section 82<br />
(1) Subject to subsections (4), (5) <strong>and</strong> (8), no law shall make any provision that is<br />
discrim<strong>in</strong>atory ei<strong>the</strong>r of itself or <strong>in</strong> its effect.<br />
(2) Subject to subsections (6), (8) <strong>and</strong> (9), no person shall be treated <strong>in</strong> a<br />
discrim<strong>in</strong>atory manner by a person act<strong>in</strong>g by virtue of any written law or <strong>in</strong><br />
<strong>the</strong> performance of <strong>the</strong> functions of a public office or a public authority.<br />
(3) In this section <strong>the</strong> expression “discrim<strong>in</strong>atory” means afford<strong>in</strong>g different<br />
treatment to persons attributable wholly or ma<strong>in</strong>ly to <strong>the</strong>ir respective<br />
descriptions by race, tribe, place of orig<strong>in</strong> or residence or o<strong>the</strong>r local<br />
connection, political op<strong>in</strong>ions, colour, creed or sex whereby persons of one<br />
such description are subjected to disabilities or restrictions to which persons<br />
of ano<strong>the</strong>r such description are not made subject or are accorded privileges<br />
or advantages which are not accorded to persons of ano<strong>the</strong>r such<br />
description.<br />
(4) Subsection (1) shall not apply to any law that makes provision-<br />
(a) with respect to persons who are not citizens of Kenya;<br />
(b) with respect to adoption, marriage, divorce, burial, devolution of<br />
property on death or o<strong>the</strong>r matters of personal law;<br />
(c) for <strong>the</strong> application <strong>in</strong> <strong>the</strong> case of members of a particular race or tribe of<br />
customary law with respect to any matter to <strong>the</strong> exclusion of any law<br />
