transmission, <strong>the</strong> Acts seek to: 1) raise awareness about HIV <strong>and</strong> educate <strong>the</strong><br />

populace about its modes of transmission <strong>and</strong> prevention; 2) regulate HIV test<strong>in</strong>g<br />

<strong>and</strong> prohibit compulsory test<strong>in</strong>g subject to certa<strong>in</strong> exceptions; 3) generally<br />

promote public <strong>health</strong>; <strong>and</strong> 4) protect <strong>the</strong> <strong>human</strong> <strong>rights</strong> of people liv<strong>in</strong>g with<br />

HIV/AIDS, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> <strong>rights</strong> to equality, non-discrim<strong>in</strong>ation, <strong>and</strong> privacy. 432<br />

[48] In respect of <strong>the</strong> crim<strong>in</strong>alization provisions, section 24 of <strong>the</strong> Kenyan HIV/AIDS<br />

Prevention Act says:<br />

24. Prevention of transmission<br />

(1) A person who is <strong>and</strong> is aware of be<strong>in</strong>g <strong>in</strong>fected with HIV or is carry<strong>in</strong>g <strong>and</strong> is aware of<br />

carry<strong>in</strong>g <strong>the</strong> HIV virus shall-<br />

(a) Take all reasonable measures <strong>and</strong> precautions to prevent <strong>the</strong> transmission of HIV to o<strong>the</strong>rs;<br />

<strong>and</strong><br />

(b) Inform, <strong>in</strong> advance, any <strong>sexual</strong> contact or person with whom needles are shared of that fact.<br />

(2) A person who is <strong>and</strong> is aware of be<strong>in</strong>g <strong>in</strong>fected with HIV or who is carry<strong>in</strong>g <strong>and</strong> is aware of<br />

carry<strong>in</strong>g HIV shall not, know<strong>in</strong>gly <strong>and</strong> recklessly, place ano<strong>the</strong>r person at risk of becom<strong>in</strong>g<br />

<strong>in</strong>fected with HIV unless that o<strong>the</strong>r person knew that fact <strong>and</strong> voluntarily accepted <strong>the</strong> risk of<br />

be<strong>in</strong>g <strong>in</strong>fected.<br />

(3) A person who contravenes <strong>the</strong> provisions of subsections (1) or (2) commits an offence <strong>and</strong><br />

shall be liable upon conviction to a f<strong>in</strong>e not exceed<strong>in</strong>g five hundred thous<strong>and</strong> shill<strong>in</strong>gs or<br />

imprisonment for a term not exceed<strong>in</strong>g seven years, or to both such f<strong>in</strong>e <strong>and</strong> imprisonment.<br />

Section 47 of <strong>The</strong> Tanzanian HIV/AIDS (Prevention <strong>and</strong> Control Act says:<br />

Any person who <strong>in</strong>tentionally transmits HIV to ano<strong>the</strong>r person commits an offence <strong>and</strong> shall on<br />

conviction be liable to imprisonment to a term not less than five years <strong>and</strong> not exceed<strong>in</strong>g ten<br />

years.<br />

[49] In addition to special HIV/AIDS legislation, Kenya crim<strong>in</strong>alises HIV <strong>in</strong> <strong>the</strong><br />

Sexual Offences Act. Section 26 of <strong>the</strong> Kenyan Sexual Offences Act provides that:<br />

26. (1) Any person who, hav<strong>in</strong>g actual knowledge that he or she is <strong>in</strong>fected with HIV or any o<strong>the</strong>r<br />

life threaten<strong>in</strong>g <strong>sexual</strong>ly transmitted disease <strong>in</strong>tentionally, know<strong>in</strong>gly <strong>and</strong> willfully does<br />

anyth<strong>in</strong>g or permits <strong>the</strong> do<strong>in</strong>g of anyth<strong>in</strong>g which he or she knows or ought to reasonably know -<br />

(a) will <strong>in</strong>fect ano<strong>the</strong>r person with HIV or any o<strong>the</strong>r life threaten<strong>in</strong>g <strong>sexual</strong>ly transmitted disease;<br />

(b) is likely to lead to ano<strong>the</strong>r person be<strong>in</strong>g <strong>in</strong>fected with HIV or any o<strong>the</strong>r life threaten<strong>in</strong>g<br />

<strong>sexual</strong>ly transmitted disease;<br />

(c) will <strong>in</strong>fect ano<strong>the</strong>r person with any o<strong>the</strong>r <strong>sexual</strong>ly transmitted disease,<br />

shall be guilty of an offence, whe<strong>the</strong>r or not he or she is married to that o<strong>the</strong>r person, <strong>and</strong> shall be<br />

liable upon conviction to imprisonment for a term of not less than fifteen years but which may be<br />

for life.<br />

[50] To a large extent, section 24 of <strong>the</strong> Kenyan HIV/AIDS Prevention <strong>and</strong> Control<br />

Act <strong>and</strong> section 26 of <strong>the</strong> Kenyan Sexual Offences Act are regulat<strong>in</strong>g <strong>the</strong> same<br />

conduct – transmission of HIV <strong>and</strong> yet punish <strong>the</strong> prohibited conduct differently.<br />
