<strong>4.1</strong>.4. Specific legal <strong>in</strong>struments regulat<strong>in</strong>g <strong>the</strong> work of domestic workers<br />
Most countries <strong>in</strong> <strong>the</strong> region exclude domestic workers from <strong>the</strong> scope of<br />
<strong>the</strong>ir labour laws, <strong>and</strong> this exclusion is highly problematic for <strong>the</strong> effective<br />
protection of <strong>the</strong>ir rights as workers. The notable exception is Jordan, which<br />
amended its Labour Law <strong>in</strong> 2008 to repeal <strong>the</strong> provision exclud<strong>in</strong>g domestic<br />
workers <strong>and</strong> m<strong>and</strong>at<strong>in</strong>g <strong>the</strong> M<strong>in</strong>istry of Labour to issue regulations regard<strong>in</strong>g<br />
domestic workers. 46 In 2009 such a regulation was issued, sett<strong>in</strong>g out <strong>the</strong><br />
respective obligations of employers <strong>and</strong> workers <strong>in</strong> domestic labour contexts<br />
<strong>and</strong> conta<strong>in</strong><strong>in</strong>g provisions relat<strong>in</strong>g to work<strong>in</strong>g hours, paid leave <strong>and</strong> work<strong>in</strong>g<br />
conditions. 47 In 2012, Bahra<strong>in</strong> also extended coverage of certa<strong>in</strong> provisions of<br />
its new Labour Law to domestic workers, <strong>in</strong>clud<strong>in</strong>g those relat<strong>in</strong>g to labour<br />
contracts, wage calculations, annual leave <strong>and</strong> dispute settlements. 48<br />
O<strong>the</strong>r countries have taken <strong>the</strong> approach of develop<strong>in</strong>g separate legal provisions<br />
specific to domestic workers, through ei<strong>the</strong>r laws or regulations. Kuwait,<br />
Lebanon, Qatar, Saudi Arabia, <strong>and</strong> <strong>the</strong> UAE are among those countries that<br />
have drafted specific laws regulat<strong>in</strong>g <strong>the</strong> work of domestic workers, although<br />
to date none of <strong>the</strong>se provisions have been enacted. However, some countries<br />
<strong>in</strong> <strong>the</strong> region have already adopted separate labour regulations govern<strong>in</strong>g<br />
domestic workers. Kuwait’s Labour Law, which excludes domestic workers,<br />
provides that rules <strong>and</strong> regulations govern<strong>in</strong>g <strong>the</strong> relationship between <strong>the</strong>m<br />
<strong>and</strong> <strong>the</strong>ir employers shall be established <strong>in</strong>stead by m<strong>in</strong>isterial decision. 49 A<br />
resolution issued <strong>in</strong> 2010 provides for certa<strong>in</strong> guarantees for domestic workers<br />
related to <strong>the</strong> m<strong>in</strong>imum wage, work<strong>in</strong>g hours <strong>and</strong> annual paid leave. 50 At <strong>the</strong><br />
same time, draft legislation on domestic work is reportedly under review by<br />
<strong>the</strong> National Assembly.<br />
Aside from <strong>the</strong> laws <strong>and</strong> regulations described above, several countries have<br />
<strong>in</strong>troduced st<strong>and</strong>ard employment contracts; <strong>in</strong> many cases, <strong>the</strong>se contracts<br />
constitute <strong>the</strong> only form of legal protection for migrant domestic workers.<br />
In Lebanon, <strong>the</strong> st<strong>and</strong>ard contract sets out <strong>the</strong> respective obligations of<br />
employers <strong>and</strong> workers <strong>and</strong> conta<strong>in</strong>s provisions regard<strong>in</strong>g food <strong>and</strong> hous<strong>in</strong>g,<br />
work<strong>in</strong>g hours, term<strong>in</strong>ation of <strong>the</strong> contract <strong>and</strong> o<strong>the</strong>r conditions of work. 51<br />
O<strong>the</strong>r countries that have developed st<strong>and</strong>ard employment contracts <strong>in</strong>clude<br />
Bahra<strong>in</strong>, Jordan, Kuwait, Oman <strong>and</strong> <strong>the</strong> UAE.<br />
