The onus is <strong>the</strong>refore on <strong>the</strong> country of orig<strong>in</strong> to implement <strong>the</strong> ban, but<br />

this is not an easy task. As an official from <strong>the</strong> Philipp<strong>in</strong>es Embassy <strong>in</strong> Jordan<br />

remarked, “our Constitution gives us <strong>the</strong> right to travel <strong>and</strong> recruitment<br />

agencies exploit this constitutional right. We cannot discrim<strong>in</strong>ate <strong>and</strong> say,<br />

‘You look like a domestic worker <strong>and</strong> can’t travel because of <strong>the</strong> ban.’ In<br />

Jordan, Filip<strong>in</strong>os can enter on a visa valid for 60 days, <strong>and</strong> <strong>the</strong>n can convert<br />

it <strong>in</strong>to a work visa.” 25 In Lebanon, ano<strong>the</strong>r official from <strong>the</strong> Philipp<strong>in</strong>es<br />

Embassy stated that s<strong>in</strong>ce <strong>the</strong> imposition of <strong>the</strong> deployment ban adopted <strong>in</strong><br />

2006, 26 <strong>the</strong> number of domestic workers from <strong>the</strong> Philipp<strong>in</strong>es had actually<br />

<strong>in</strong>creased, with on average 11,000 Filip<strong>in</strong>os f<strong>in</strong>d<strong>in</strong>g jobs <strong>in</strong> Lebanon each<br />

year. 27 O<strong>the</strong>r countries of orig<strong>in</strong> that have imposed bans face similar limits<br />

on <strong>the</strong>ir capacity to enforce <strong>the</strong>m. Corruption <strong>and</strong> lax emigration controls<br />

<strong>in</strong> countries of orig<strong>in</strong> also contribute to expla<strong>in</strong><strong>in</strong>g why <strong>the</strong> bans do not<br />

necessarily help curb <strong>the</strong> number of domestic workers migrat<strong>in</strong>g. 28 “In<br />

countries where <strong>the</strong>re is a ban, a lot of agencies work cl<strong>and</strong>est<strong>in</strong>ely, without<br />

any licence,” said an official of a recruitment agency <strong>in</strong> Lebanon. “S<strong>in</strong>ce <strong>the</strong>y<br />

are pay<strong>in</strong>g money to some people <strong>in</strong> <strong>the</strong> Government, <strong>the</strong>y are able to obta<strong>in</strong><br />

<strong>the</strong> necessary documents for <strong>the</strong> girls to leave <strong>the</strong> country.” 29<br />

Where deployment bans are <strong>in</strong> place, domestic workers <strong>and</strong> PEAs have<br />

colluded to f<strong>in</strong>d ways to circumvent <strong>the</strong> restrictions. As an official from<br />

W<strong>in</strong>rock International <strong>in</strong> Bangladesh expla<strong>in</strong>ed, “<strong>the</strong> consequences of <strong>the</strong><br />

bans imposed by <strong>the</strong> Government of Bangladesh is that unskilled <strong>and</strong> semiskilled<br />

women migrant workers ma<strong>in</strong>ly migrated through irregular channels<br />

which made <strong>the</strong>m more vulnerable to exploitation”. 30 A Filip<strong>in</strong>a domestic<br />

worker confessed dur<strong>in</strong>g her <strong>in</strong>terview that “as <strong>the</strong>re is a ban <strong>in</strong> Lebanon, my<br />

visa was for Bahra<strong>in</strong>. It said I would be visit<strong>in</strong>g my mo<strong>the</strong>r <strong>the</strong>re, but it’s not<br />

true, she is not <strong>the</strong>re. I had to memorize <strong>the</strong> data given to me by my agent<br />

before travell<strong>in</strong>g.”<br />

In <strong>the</strong> Philipp<strong>in</strong>es, Rule III, section 6 of <strong>the</strong> amended Migrant Workers Act, 2010,<br />
