to legally term<strong>in</strong>ate a contract after <strong>the</strong> probation period, <strong>and</strong> <strong>the</strong>refore it is<br />

important to consider revis<strong>in</strong>g <strong>the</strong>m <strong>in</strong> l<strong>in</strong>e with <strong>in</strong>ternational st<strong>and</strong>ards.<br />

Mechanisms for sett<strong>in</strong>g a m<strong>in</strong>imum wage rema<strong>in</strong> relatively undeveloped <strong>in</strong><br />

<strong>the</strong> Arab region, yet <strong>the</strong>y are essential to overcome asymmetries <strong>in</strong> barga<strong>in</strong><strong>in</strong>g<br />

power or <strong>the</strong> lack of effective collective barga<strong>in</strong><strong>in</strong>g. 3 In <strong>the</strong> words of <strong>the</strong><br />

M<strong>in</strong>imum Wage Fix<strong>in</strong>g Convention, 1970 (No. 131), one of <strong>the</strong>ir ma<strong>in</strong><br />

objectives is to protect “disadvantaged groups of wage earners” aga<strong>in</strong>st “unduly<br />

low wages”. Governments <strong>in</strong> <strong>the</strong> <strong>Middle</strong> <strong>East</strong> reiterated <strong>the</strong>ir commitment to<br />

set up a study on <strong>the</strong> establishment of a m<strong>in</strong>imum wage <strong>in</strong> <strong>the</strong> region at<br />

<strong>the</strong> tripartite meet<strong>in</strong>g on wage policies <strong>in</strong> Amman <strong>in</strong> 2012. 4 Fix<strong>in</strong>g sectoral<br />

m<strong>in</strong>imum wages for vulnerable workers, that do not discrim<strong>in</strong>ate between<br />

nationals <strong>and</strong> migrant workers, would help protect those workers at <strong>the</strong><br />

bottom of <strong>the</strong> wage distribution from fur<strong>the</strong>r exploitation.<br />

In putt<strong>in</strong>g <strong>the</strong>se measures <strong>in</strong> place, special attention needs to be paid to<br />

avoid<strong>in</strong>g undervaluation of certa<strong>in</strong> sectors, <strong>in</strong>clud<strong>in</strong>g domestic work, as <strong>the</strong>re<br />

is <strong>the</strong> risk that m<strong>in</strong>imum wages will be set systematically lower for femaledom<strong>in</strong>ated<br />

sectors than for male-dom<strong>in</strong>ated sectors with similar skill profiles. 5<br />

The adoption of m<strong>in</strong>imum wages for all sectors would reduce discrim<strong>in</strong>ation<br />

aga<strong>in</strong>st migrant workers based on national orig<strong>in</strong>, <strong>and</strong> would also reduce<br />

competition between countries of orig<strong>in</strong>, some of which have sought to reta<strong>in</strong><br />

<strong>the</strong>ir competitive edge <strong>in</strong> overseas labour markets by fail<strong>in</strong>g to regulate <strong>the</strong><br />

wages of <strong>the</strong>ir migrant workers. It would fur<strong>the</strong>r avoid compartmentalization,<br />

especially of domestic workers, ensur<strong>in</strong>g that policies are developed on <strong>the</strong><br />

basis of a basic package of entitlements for all migrant workers.<br />

In deal<strong>in</strong>g with <strong>the</strong> labour law deficit perta<strong>in</strong><strong>in</strong>g to domestic workers,<br />

governments <strong>and</strong> social partners can refer to ILO Domestic Workers<br />

Convention, 2011 (No. 189), <strong>and</strong> <strong>the</strong> accompany<strong>in</strong>g Recommendation<br />

(No. 201), <strong>in</strong> develop<strong>in</strong>g <strong>the</strong>ir own normative framework on domestic work.<br />

Improv<strong>in</strong>g work<strong>in</strong>g conditions <strong>in</strong> <strong>the</strong> sector would have broader ramifications<br />

for greater gender equality, as <strong>the</strong> ILO estimates <strong>the</strong>re are 2.1 million domestic<br />

workers <strong>in</strong> <strong>the</strong> <strong>Middle</strong> <strong>East</strong>, <strong>and</strong> that one <strong>in</strong> five women workers <strong>in</strong> <strong>the</strong> region<br />

are domestic workers. 6 In October 2012 <strong>the</strong> ILO organized a high-level<br />

regional tripartite conference on decent work for domestic workers, at which<br />

it was agreed with ILO constituents from <strong>the</strong> region that exist<strong>in</strong>g national<br />

protection mechanisms should be exp<strong>and</strong>ed to <strong>in</strong>clude domestic workers. 7<br />
