The General Survey fur<strong>the</strong>r underscored <strong>the</strong> l<strong>in</strong>k between human traffick<strong>in</strong>g<br />

for labour <strong>and</strong> sexual exploitation by stat<strong>in</strong>g that:<br />

While a certa<strong>in</strong> dist<strong>in</strong>ction has been drawn <strong>in</strong> <strong>the</strong> above def<strong>in</strong>ition between<br />

traffick<strong>in</strong>g for forced labour or services <strong>and</strong> traffick<strong>in</strong>g for sexual exploitation, this<br />

should not lead to a conclusion that coercive sexual exploitation does not amount<br />

to forced labour or services, particularly <strong>in</strong> <strong>the</strong> context of human traffick<strong>in</strong>g. It<br />

seems clear that coercive sexual exploitation <strong>and</strong> forced prostitution do come with<strong>in</strong><br />

<strong>the</strong> scope of <strong>the</strong> def<strong>in</strong>ition of forced or compulsory labour <strong>in</strong> Article 2, paragraph 1,<br />

of <strong>the</strong> Convention. 10<br />

It should also be noted that <strong>the</strong> ILO recognizes that all workers deserve legal<br />

protection from abuse <strong>and</strong> exploitation, regardless of <strong>the</strong> legality of <strong>the</strong> work<br />

<strong>the</strong>y perform under <strong>the</strong> law of <strong>the</strong> state where it is performed, whe<strong>the</strong>r it<br />

takes place <strong>in</strong> <strong>the</strong> formal or <strong>in</strong>formal economy, or whe<strong>the</strong>r <strong>the</strong> worker has an<br />

established right to work <strong>in</strong> <strong>the</strong> country concerned.<br />
