employers <strong>and</strong> <strong>the</strong> recruitment agencies. 35 The role of PEAs is restricted to <strong>the</strong><br />
recruitment procedure <strong>and</strong> <strong>the</strong> three-month probation period after <strong>the</strong> arrival<br />
of <strong>the</strong> domestic worker. 36 As one author of a study on migrant domestic work<br />
expla<strong>in</strong>ed, “once <strong>the</strong> three months have passed, private employment agencies<br />
no longer have a legal role to <strong>in</strong>tervene <strong>in</strong> disputes between employers <strong>and</strong><br />
migrant domestic workers, although agents are still required to report any<br />
compla<strong>in</strong>ts received to <strong>the</strong> relevant authorities”. 37<br />
Box 3.1. The role of private employment agencies<br />
“The private recruitment agencies sell <strong>and</strong> buy domestic workers <strong>and</strong> <strong>the</strong>y<br />
actually use that language of ‘buy<strong>in</strong>g’ <strong>and</strong> ‘sell<strong>in</strong>g’. We are return<strong>in</strong>g to <strong>the</strong><br />
<strong>Middle</strong> Ages. Take one example of <strong>the</strong> employer who returns his domestic<br />
worker to <strong>the</strong> recruitment agency, <strong>and</strong> receives US$500 as compensation.<br />
The agency will <strong>the</strong>n sell her to ano<strong>the</strong>r employer for US$1,000 $ <strong>and</strong> keep<br />
<strong>the</strong> profit. The first employer will sign <strong>the</strong> release at <strong>the</strong> M<strong>in</strong>istry of Interior<br />
<strong>and</strong> <strong>the</strong> M<strong>in</strong>istry does not see <strong>the</strong> f<strong>in</strong>ancial transaction, only <strong>the</strong> consensual<br />
release.”<br />

Some key <strong>in</strong>formants believed that <strong>the</strong> <strong>in</strong>volvement of recruitment agencies<br />
was not always to <strong>the</strong> benefit of <strong>the</strong> domestic workers (see box 3.1). Indeed,<br />
<strong>the</strong>re were several allegations that some recruitment agents <strong>in</strong>tervene only<br />
because <strong>the</strong>re are profits to be made. An official from <strong>the</strong> Kenyan Consulate<br />
<strong>in</strong> Lebanon upheld <strong>the</strong> viewpo<strong>in</strong>t that “<strong>the</strong> agency takes anywhere between<br />
US$3,000 <strong>and</strong> US$4,000 from <strong>the</strong> employer, which is a lot of money. It’s a<br />
war between us <strong>and</strong> <strong>the</strong> agents.” 38 An official of <strong>the</strong> syndicate of PEA owners<br />
<strong>in</strong> Lebanon agreed, specify<strong>in</strong>g that “<strong>the</strong> problem lies with those agencies that<br />
are not licensed – I like to call it <strong>the</strong> ‘monkey bus<strong>in</strong>ess’. There are currently<br />
460 licensed agencies operat<strong>in</strong>g <strong>in</strong> Lebanon. I can say that 200 operate <strong>in</strong><br />
a professional <strong>and</strong> responsible way.” 39 Recogniz<strong>in</strong>g <strong>the</strong> problems brought<br />
about by certa<strong>in</strong> recruitment agencies, <strong>the</strong> Government of Lebanon recently<br />
cancelled 40 licences of agencies that were <strong>in</strong> violation of national regulations<br />
<strong>in</strong> 2011.<br />
