CAPITAL REQUIREMENTS DIRECTIVE IV INSTRUMENT 2013
Powers exercised
A. The Financial Conduct Authority makes this instrument in the exercise of the
following powers and related provisions in the Financial Services and Markets Act
2000 (“the Act”):
(1) section 137A (The FCA’s general rules);
(2) section 137T (General supplementary powers);
(3) section 138D (Actions for damages); and
(4) section 139A (Power of the FCA to give guidance).
B. The rule-making powers listed above are specified for the purpose of section 138G(2)
(Rule-making instruments) of the Act.
Commencement
C. This instrument comes into force on 1 January 2014, except the provisions in IFPRU
9 (Capital buffers) do not apply until 1 January 2016.
Making the Prudential sourcebook for Investment Firms (IFPRU)
D. The Financial Conduct Authority makes the rules and gives the guidance in Annex A to
this instrument.
Amendments to the FCA Handbook
E. The Glossary of definitions is amended in accordance with Annex B to this
instrument.
F. The Senior Management, Arrangements, Systems and Controls sourcebook (SYSC) is
amended in accordance with Annex C to this instrument.
Citation
F. This instrument may be cited as the Capital Requirements Directive IV Instrument
2013.
H. The sourcebook in Annex A to this instrument may be cited as the Prudential
sourcebook for Investment Firms (or IFPRU).
